She reconvened the <br />meeting at 8:05 P.M. <br /> <br />Petition 97-01(T) - Zonin~ Text Amendment to Add Funeral Homes as a Permitted Use <br />in the Office/Limited Commercial and General Commercial Zones - Public HearinS - <br /> <br />8:00 <br /> <br /> Mr. Marshall briefly reviewed the proposed Zoning Text Amendment [(Petition <br />97-01(T)1. <br /> <br /> Chairman Casper opened the public hearing at 8:06 P.M. for Petition 97- <br />OI(T) and asked if anyone were present who wished co address the Board regarding <br />the proposed text amendment. There was no one present to address the Board, and <br />Chairman Casper closed the public hearing. <br /> <br /> UPON MOTI~ of Commissioner 5arnhart, seconded by Commissioner Mills and <br />unanimously carried, the Board approved Petition 97-01(T) amending the Cabarrus <br />County Zoning Ordinance as follows: <br /> <br />PETITION 97-0~(T) Ordinance No. 1997-05 <br /> <br /> TEXT AMENDMENT to the <br />CABARRUS COUNTY ZONING ORDINANCE <br /> <br />Purpose of Amendment: To accommodate funeral homes as an allowable land use in <br />Oabarrus County. <br /> <br />Back,round: Currently, funeral homes ere not allowed in any zoning district in <br />Cabarrus County. They need to be allowed in at least one zoning district and the <br />nature of the funeral home business fits most closely with the general purposes <br />and intents of Limited and General Commercial zoning districts. With the <br />exception of parking requirements, the development standards for these commercial <br />districts seem to be compatible with funeral homes' needs and impacts. The unique <br />parking requirements, which are not directly related to building area, are based <br />on chapel size and the need for an off-street parking area for the formation of <br />a funeral procession. These requirements are detailed in this amendment. <br /> <br /> I. Revise Chapter 3, Section 3-7, COMMERCIAL DISTRICTS, (1) Office/limited <br />commercial, USES IN THE OFFICE/LIMITED COMMERCIAL ZONE to add the following under <br />Permitted uses: <br /> <br />Funeral home <br /> <br /> II. Revise Chapter 3, Section 3-7, COMMERCIAL DISTRICTS, (2) General <br />Commercial, USES IN THE GENERAL COMMERCIAL ZONE to add the following under <br />Permitted uses: <br /> <br />Funeral home <br /> <br /> Ill. Revise Chapter 3, Section 3-8, page 3-28, 'Table of Permitted Uses: <br />INSTITUTIONAL/PUBLIC' to add the use 'Funeral home' as a Permitted ("P") use in <br />the Office/Limited Commercial ("OF/LC") zone and the General Commercial ("GEN <br /> <br /> IV. Revise Chapter 10 Parking & Loading, Section 10-6 'Table of required <br />parking spaces by use,' on page 10-4 to add the following row to the table: <br /> <br /> SI'AGES RI~UIRI{D <br /> <br /> Funeral Home One (l) for each (4) seats in the chapel or chapels, plus <br /> two (2) spaces for each thrge (3) employees, plus (1) <br /> space for each vehicle used in the operation. In <br /> addition, off-street parking area shall be provided to <br /> accommodate a minimum of thirty (30) passenger vehicles <br /> for the purpose of forming a funeral precession. <br /> <br /> <br />
