367 <br /> <br />D AFT <br /> <br />Presentation by Middleton Homeowners <br /> <br /> Mr. Chris Eaton of 8444 Mtddleton Circle, Harrisburg, addressed the Board <br />regarding stormwater flooding and related safety concerns in the Mtddleton <br />Subdivision and surrounding area. He reported a minimum of three instances <br />during the past eight years where floods have reached or exceeded the 100-year <br />flood line. Mr. Eaton further advised that a majority of the flooded homes were <br />purchased prior to the remapping of the flood plain in 1993-94. He listed the <br />two primary causes of flooding as acoumulatlon of debris in Back Creek and <br />increased development in the watershed in Cabarrus and Mecklenburg counties. <br /> <br /> Mr. James Miller of 8437 Middleton Circle, Harrisburg, discussed possible <br />solutions for the flooding problems. These solutions included the removal of <br />debris from the creek along with longer term solutions of developing and funding <br />a maintenance plan to keep the creeks and drainage areas debris free, increasing <br />storm water storage areas on Back Creek and developing new growth regulations to <br />slow the flow of water into the creek. In conclusion, Mr. Miller requested the <br />Board to take the following action: (1) Beg~n to investigate the cleaning of the <br />creek; (2) Begin to look at new regulations and action items listed in the August <br />6, 1997 memorandum by County Manager Frank'Clifton; and (3) Appoint an individual <br />to serve as contact person for the Middleton residents and other concerned <br />citizens. <br /> <br /> Chairman Casper thanked the Middleton residents for coming to the meeting <br />a~d acknowledged their concerns. She explained the issue is a multi- <br />Jurisdictional problem and stated the Board does not have a solution at this <br />time. However, she advised that approval of the proposed Soil Erosion and <br />Sedimentation Control Ordinance is the first step in perhaps a long term <br />resolution to the problem. <br /> <br /> Commissioner Mills recommended that Vice-Chairman Carpenter serve as the <br />contact person for the Middleton residents. Also, ~ice-Chairman Carpenter <br />suggested that the Board begin investigations to determine the cost of cleaning <br />the creek in the Middleton area. <br /> <br /> Chairman Casper advised that the Board will study the Middleton flooding <br />problem to decide exactly how to approach the issue. <br /> <br />Appointments - Library Board of Trustees <br /> <br /> UPON MOTION of Commissioner Niblock, seconded by Commissioner Carpenter and <br />unanimously carried, the Board reappointed Ms. Libby Morrison (Mt. Pleasant) to <br />the Library Board of Trustees and appointed Mr. Stephen Morris (Kannapolis) to <br />the Library Trustees to fill the position previously held by Mr. Chuck Thurston. <br />Both appointments were for terms of three years ending July 31, 2000. <br /> <br />Closed Session to Consult with Attorney Re~srdin~ Pendin~ Lfti~ation~ includln~ <br />Philip Morris and Lake Concord Ventures~ ss Authorized by N. C. Oeneral Statute <br />143-318.11(a)(3; <br /> <br /> UPON MOTION of Commissioner Mills, seconded by Commissioner Niblock and <br />unanimously carried, the Board moved to go into closed session to consult with <br />the Attorney regarding pending litigation, including Philip Morris and Lake <br />Concord Ventures, as authorized by N. C. General Statute 143-318.11(a)(3). <br /> <br /> UPON MOTION of Commissioner Mills, seconded by Commissioner Carpenter and <br />unanimously carried, the Board voted to adjourn the closed session. <br /> <br />No action was reported from the closed session. <br /> <br />Adjournment <br /> <br /> There being no further business to come before the Board, Chairman Casper <br />adjourned the meeting at 8:55 <br /> <br />Clerk to the Board <br /> <br /> <br />
