City acknowledges that certain lot line adjustments may be <br />necessary or desirable in connection with the development of the Project <br />by Developer and that the timely and expeditious completion of any such <br />lot line adjustment may be necessary for the timely development of the <br />Project. Accordingly, City agrees to use its best efforts to promptly <br />process and diligently pursue to completion subdivision application and/or <br />lot line adjustment requested by Developer including, but not limited to, <br />the simultaheous review and approval of any such subdivision plat and lot <br />line adjustment in order to permit development of the Project to proceed in <br />advance of recordation of a new subdivision map, if any, subject to <br />applicable laws. City further agrees that future subdivisions and lot line <br />adjustments requested by Developer will be processed and acted upon <br />promptly and with due diligence to, facilitate development of the Project. <br /> <br />~&gll.lL~lll!ltlio2~. The City recognizes that Developer is desirous of enhanced <br />sign area and height which is deemed necessary for the effective marketing of a <br />value- and entertainment-oriented mall. The City and Developer agree that the <br />scope of the development of Concord Mills is sufficiently unique to warrant <br />consideration of increased signage. The City is committed to, and shall, using its <br />best efforts work with Developer in a good faith toward approval of a signage <br />package that is mutually satisfactory and meets Developer's needs to the greatest <br />extent possible in connection with the development and marketing of Concord <br />Mills. To the extent that said signage package involves the North Carolina <br />Department of Transportation ("DOT"), the City and County agree to use their <br />best efforts to facilitate and assist the Developer in securing DOT approval in <br />connection with such signage package. <br /> <br />Ring Road. The "Ring Road" may be either a private or public roadway (in either <br />case the Ring Road shall meet City current road standards) with the determination <br />to be made jointly by the City and Developer as part of the BA. If it is finally <br />determined by the City and Developer that the Ring Road will be a public right- <br />of-way, the City agrees that (i) the Ring Road will be constructed in accordance <br />with-the' current City specifications for construction of such a roadway, and <br />(ii) the City will not unreasonably withhold its approval to or authorization of the <br />number, size and locations of all curb cuts requested by Developer as shown on <br />the Ring Road concept plan to be submitted to the City as part of the negotiations <br />of the BA. If it is finally determined by the City and Developer that the Ring <br />Road will remain a private roadway, then if necessary for the road to serve the <br />Developer property as well as adjacent private properties, Developer will grant a <br />pem~anent non-exclusive easement for ingress and egress to the adjacent property <br />owners as well as to the City over the Ring Road by an easement document <br />mutually acceptable to Developer and the City. <br /> <br />4 <br /> <br /> <br />
