Attached <br />to this letter is a copy of a letter dated September 29, 1997 from Jonathan B. Marshall, <br />Planning Services Director, advising our client that the Cabarrus County Planning and <br />Zoning Commission denied preliminary approval o£ this plat on September 18, 1997. <br />Pursuant to Section 66-10 of the subdivision regulations, our client hereby appeals the <br />decision of the Planning and Zoning Commission. <br /> <br /> We are informed that our client has complied with all of the relevant requirements <br />set forth in the subdivision regulations, and the principal basis of our appeal is, therefore, <br />that the Planning and Zoning Commission lacks authority to arbitrarily deny approval <br />when all of the requirements of the subdivision regulations have been met. <br /> <br /> Please advise us when this matter will be heard by the Board of County <br />Commissioners. <br /> <br />Sincerely, <br /> <br />ROBINtSON, BRADSHAW & HINSON, P.A. <br /> <br />RWBjr:lri <br />Enclosure <br />cc: Mr. Christopher A.
