Staff also recommends that no occupancy <br />permits be issued until access from Ellenwood Road has been <br />constructed to NCDOT specifications, as required by the <br />ordinance. With those two conditions, staff recommends approval. <br /> <br />Mr. Christopher Borst, Westbrook Highland Creek, LLC, <br />addressed the Board stating his understanding is, it will take <br />approximately four months to design and eight months to <br />construct this subdivision. <br /> <br />The Chair asked Mr. Borst if he was in agreement with the two <br />conditions that staff has recommended for approval? <br /> <br />Mr. Borst said yes he is in agreement with the conditions of the <br />staff. <br /> <br />There being no further comments, Mr. Ritchie MOTIONED to <br />approve Highland Creek subdivision plat preliminary with the two <br />conditions outli~ed by the staff, seconded by Mr. Dwiggins. The <br />vote was 4 to 4. Mr. Ritchie, Mr. Dwiggins, Mr. Hill, and Mr. <br />Starnes - affit.-.-~ative. Mr. Babb, Mr. Moose, Mr. Drye, and Mr. <br />Kiefer - negative. The Motion to approve Highland Creek <br />subdivision plat preliminary was denied for lacking of a clear <br />majority. <br /> <br />The Chair introduced the second item on the Agenda, Zoning <br />Amendment, Petition 97-15: <br /> <br />Applicanl: Linda Cook/Frances Miller <br />Request Zoning Atlas Amendment <br /> <br />This was a request to the Cabarrus County Planning and Zoning <br />Commission from Linda Cook and Frances Miller to have their <br />property located on Cold Springs Road, South, rezoned from Low <br />Density Residential to Medium Density Residential - Special Use, <br />to develop a single family residential subdivision. <br /> <br />The Chair swore in Mr. Jonathan B.
