(1) Impoundment and disposition of all animals coming £nto the anima!
<br /> shelter or shelters.
<br />(2) Bite cases, violations and com~laints, and investigation of same.
<br />(3) All moneys belonging to the county which were derived from impoundment
<br /> fees, penalties and license tags, and sales of animals.
<br />(4) All other records deemed necessary by the County Manager.
<br />
<br />Section 4. Definitions.
<br />
<br />(1) Animal: Every vertebrate nonhuman species of animal, wild or
<br /> domestic, male or female, including, but not limited te dogs, cats,
<br /> livestock, and other mammals, birds, reptiles, amphibians, and fish.
<br />(2) Animal Control Officers: Persons properly appointed to pick up,
<br /> restrain, impound, sell or dispose of dogs, cats, or other animals and
<br /> who are responsible for discharging such other duties and functions as
<br /> may be prescribed by the Cabarrus County Board of Commissioners by
<br /> this or any other county ordinance er by state law, or pursuant to
<br /> interlocal agreements executed pursuant to Section 2.
<br />(3) Animal Shelter: Any facility designated by the Cabarrus County Board
<br /> of Commissioners for the purpose of impounding and caring for all
<br /> animals found running at large or otherwise subject to impounding in
<br /> accordance with the provisions of this Ordinance, ordinances of
<br /> Cabarrus County, or the General Statutes of North Carolina.
<br />(4) Breeder: Any person or persons engaged in the commercial business of
<br /> breeding animals for sale.
<br />(5) Cat: A domestic feline of either sex over six (6) months of age.
<br />(6) County/City: Cabarrus County exclusive of territory under the
<br /> jurisdiction of a municipality, except where the governing body of the
<br /> municipality has requested the county to provide animal control within
<br /> the municipality and has adopted the Cabarrus County Animal Control
<br /> Ordinance.
<br />(7) Day: For calculation of time passage, day shall be considered as a
<br /> regular workday, exclusive of Saturday, Sunday, and County holidays.
<br />(8) Department: The Cabarrus County Animal Control Department, a division
<br /> of the Cabarrus County Sheriffs Department.
<br />(9) Do~: A domestic canine of either sex over six (6) months of age.
<br />(10) Dangerous Animal: Any animal whose behavior constitutes a reasonable
<br /> risk of injuring a human or animal or damaging personal or real
<br /> property. That behavior includes, but is not limited to, an animal
<br /> biting or attempting to attack a human or another animal. However,
<br /> this definition shall not apply to any animal that has been subjected
<br /> to provocation or if the victim has been trespassing upon the owner's
<br /> premises.
<br />(11) Exposed to Rabies: Any animal or human bitten by or exposed to any
<br /> animal known or suspected to have been infected with rabies.
<br />(12) HarborinK an Animal: An animal shall be deemed to be harbored if it
<br /> is fed or sheltered three days or more, unless the animal is being
<br /> boarded for a fee.
<br />(13) Health Director: The Director of the Cabarrus County Health
<br /> Department or a duly authorized agent thereof.
<br />(14) Impound: Any animal which is received into custody by any employee or
<br /> the Department.
<br />(15) Inoculation: The vaccination of a dog or cat with antirabic vaccine
<br /> approved by the United States Bureau of Animal Industry, the North
<br /> Carolina Department of Agriculture, and the North Carolina State Board
<br /> of Health at such time or times as shall be required by the General
<br /> Statutes of North Carolina, the North Carolina Department of
<br /> Environment, Health, and Natural Resources, the Commission for Health
<br /> Services, the State Health Director, or the local health director as
<br /> defined in Chapter 130A-186 of the North Carolina General Statutes as
<br /> they may be subsequently amended.
<br />(16) Neutered Hale: Any male dog or cat which has been rendered sterile by
<br />a surgical procedure (orchiectomy).
<br />(17) Owner: Any person, group of persons, firm, organization, association,
<br /> society, club, lodge, partnership, syndicate, trustee, or corporatlo~
<br /> owning, keeping, having charge of, sheltering, feeding, harboring, or
<br /> taking care of any animal for three or more consecutive days unless
<br /> the animal is boarded for a fee. If commercial kennel is involved for
<br /> breeding, then ownership shall be indicated by the kennel operator by
<br /> showing the registration of the animal in the na~e of the actual owner
<br /> of the animal.
