CABARRUS COUNTY FUEL SERVICE Bid No. 95-012 INSTRUCTIONS TO BIDDERS Sealed bids will be opened at the time and place shown on the enclosed Invitation to Bid form. Bids not submitted in a sealed package will not be accepted. Late bids will not be considered. Bids will be examined promptly aRer opening and an award made at the earliest possa~ole date. BOND/DEPOSIT REQUIREMENTS: BID DEPOSIT: All bids must be acco,:~panied by a bid deposit. NOTE CAREFULLY...Thi.~ deposit may take the form of cash, certified check, cashier's check, or bond, and must be in the amount of at least 5% of the bid. The bond must be "executed by a corporate Surety licensed under the hws of North Carolina" to execute such bonds: (G.S. 143-129). The cash, ca~hie~s check, or certified check may be retained if the successful bidder hils to enter into the proposed contract. The above bid deposit is required by State Law and may not be modified. Bidders should therefore comply with thl.q requirement carefully and specifically, ifa bid bond is utili?ed, the Surety must be a corporate Surety authorized to do bu.4ness in North Carolina. Bank money orders, uncertified checks, telegraphic money orders, etc., are not acceptable of bid deposits. Bid deposits ofunsuccessfixl bidders will be returned as soon as the contract is awarded. The successful bidder's deposit will be returned upon proper and eoa~,lete execution of the contract. AWARD OF BID: Bids shall be awarded to the lowest responsible bidder talcing into consideration quality, past perfo~,,snce and the time specified in the proposals for the performance of the contract. Each bidder shall submit a proposal on the enclosed bid rosins provided. The bid must be signed by an authorized official of the fimz Bids may be rejected if they show any omissions, alterations of roma, additions not called for, conditional bid, or any irregafladfies of any kind. The County reserves the right to reject any or all proposals. It further reserves the right to waive fox,iallties and technicalities insofar as it is authorized to do so, where it deem.q it advisable in protection of the best interest of the County.
