Comments are provided below. <br /> <br />~0M1V~N~' A~ EXPLANATION8;: <br /> <br />The 1992 Cable Act requires cable operators to charge rates based on actual costs for installation and <br />lease of subscriber equipment. Regulated equipment includes all of the equipment located in the <br />subscriber's home, including converter boxes, remote control units, connections for additional <br />television receivers, and other cable wiring used to obtain basic service. Cable operators must <br />complete and file with the Franchise Authority an FCC Form 1205 at the same time they file an FCC <br />Form 1240. Therefore, Time Warner delivered its required FCC Form 1205 to Cabarrus County and <br />Centralina on 12-29-95, the same day it delivered the FCC Form 1240. <br /> <br />As part of the Social Contract between Time Warner and the FCC, a waiver was given to Time <br />Warner allowing them to calculate their equipment costs on a state-wide basis, rather than calculating <br />equipment and installation costs based only on the Metrolina system. This means that equipment and <br />installation co~s will now be spread across all Time Warner subscribers in North Carolina, rather <br />than in just the Metrolina system. <br /> <br />A review of the supporting data substantiates that the equipment and installation rates calculated for <br />1996 are accurate, and should be approved by the Franchise Authority.
