119 Appointment - Social Services Board UPON MOTION of Chairman Barnhart, seconded by Commissioner Mllls and uru~nimously carried, the Eoard appointed Hr. Wa)"ne Trexler to the Social Services Board for a term of three years ending June 30, 1999. Mr. Trexler filled the position previously held by Ms. Susan Fuller who had served six years and was ineligible for reappointment. Duke Power Right-of-Way for Service to Plantation Pipeline Factl£ttes UPON MOTION of Chairman Barnhart, seconded by Commissioner Casper and unanimously carried, the Eoard by resolution declared as surplus a proposed right of way to serve the facilities operated by Plantation Pipeline in the vicinity of the Coddle Creek Reservoir and authorized the transfer of the identified right of way to Duke Power Company at a cost of ~1.00 to be advertised for ten (10) days and subject to upset bid. The right of way is hounded by the lands of: South - Mooresville Highway; North - Coddle Creek Reaervo£r; West - Coddle Creek Reservoir; and East - Robert Dayvault (7880 Mooresvflle Road). Interim Operation A~reement with the Water and Sewer Authority UPON MOTION of Commissioner Nlblock, seconded by Commissioner Casper and unanimously carried, the Board approved the followin§ Interim Operation Agreement between Cabarrus County and the Water and Sewer Authority for the operation of the Coddle Creek Reservoir. NORTH CAROLINA CABARRUS COUNTY INTERIM OPERATION AGREEMENT FOR THE OPERATION AND MAINTENANCE OF THE CODDLE GREEK RESERVOIR THIS INTERIM '~PERATION AGREEMENT (hereinafter referred to as the "Agreement"), made and entered into as of the latter of the dates the ~overning boards' approvals are set forth herein, by and between CABARRUS COUNTY, a body politic and political subdivision of the State of North Carolina (hereinafter referred to as "County"); and the WATER AND SEWER AUTHORITY OF CABARRUS COUNTY, a public corporation of the State of North Carolina (hereafter referred to as "WSACC"); WITNESSETH: that- WHEREAS, the County currently owns, operates and maintains the Coddle Creek Reservoir ("Reservoir"); and WHEREAS, the County believes it will be in the best interest of the citizens of Cabarrus County for WSACC to operate, maintain and own the Reservoir; and W~EREAS, WSACC's Board of Directors are comprised of representatives from Cabarrus County, the Cities of Concord and Kannapolis and the To~ms of Harrisburg and Mt. Pleasant, and are, therefore, responsive to minimizing the operation and maintenance costs of the Reservoir and believes it to be appropriate for WSACC to assume the operation, maintenance and ownership of the Reservoir; and WHEREAS, both the County and WSACC wish to enter into an agreement for the operation, maintenance and transfer of ownership of the Reservoir from the County to WSACC; NOW, THEREFORE, in consideration of the covenants contained herein, the County and WSACC hereby agree as follows: AGREEMENT 1. The staffs of the County and WSACC will complete a final Agreement which identifies and resolves all issues pertinent to the operation, maintenance and transfer of ownership of the Reservoir from the County to WSACC, such transfer to occur within si~ty (60) days subsequent to the final debt payment made by the County. 2. WSACC agrees to operate and maintain the Reservoir at the same high level of performance that has been demonstrated at other facilities, and in accordance with applicable State and Federal Regulations. These responsibilities include, but are not limited to, the following: (a) Determining the amount of raw water withdrawn by the Cities of Concord and Kannapolts and any future customers and billing each monthly;
