134 <br /> <br /> There was no one present to address the Board, and Chairm~n Barnhart closed <br />the public hearing. <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Fennel and <br />unanimously carried, the Board set the second public hearing for the 1997 <br />Community Development Block Grant Program application at 7:00 P.M. on Monday, <br />August 19, 1996. <br /> <br /> Mr. Stark requested that in lieu of his being paid for the preparation of <br />the CDBG grant application that the Board authorize the Chairman to write a <br />letter to County employees asking that each donate ten (10) cans of food to be <br />given to Loaves and Fishes, a non-profit group that distributes food to low <br />income families in several counties around Charlotte, including Cabarrus County. <br />The Board agreed to this request. The Planning Department will serve as the <br />collection point for the donated food. <br /> <br />Zonin~ Text ~mendment - Public MearlnK - 7:00 P.M. <br /> <br /> Mr. Jonathan Marshall, Senior Planner, reviewed Petition 96-04(T) to permit <br />duplexes in the Low Density Residential district based on standards. This <br />petition had been approved by the Planning and Zoning Commission and the public <br />hearing notice had been published. <br /> <br /> At 7:10 P.M., Chairman Barnhart opened the public hearing for Petition 96- <br />04(T) and asked if anyone were present who wished to speak either for or against <br />the proposed amendment. There was no one present to address the Board, and <br />Chairman Barnhart closed the public hearing. <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Fennel and <br />unanimously carried, the Board adopted the following Ordinance Amending the <br />Cabarrus County Zoning Ordinance. <br /> <br />PETITION 96-04(T) <br /> AN ORDINANCE AMENDING THE CABARRUS COUNTY <br /> ZONING ORDINANCE <br /> <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby <br />amended as follows: <br />1. Section 3-7. "Uses in Low Density Residential', "Permitted <br />based on Standards (PBS)", add 'Duplex'. <br />2. Section 3-8. 'Table of Permitted Uses', alter chart to <br />indicate 'Duplex" as a PBS use in Low Density Residential. <br />3. Section 7-4. 'Uses Permitted Based on Standards (PBS)". <br />Number 14 "Duplex" add Low Density Residential to the 'zones <br />permitting based on standards'. <br />4. Section 7-4. Alter Table Two to indicate the change made to <br />Number 14. <br />Adopted this the 22nd day of 3uly, 1996 by the Caharrus County Board <br />of Commissioners. <br /> /s/ Jeffrey L. Bonds, Clerk to the Board <br /> <br />Zonin~ Atlas Amendment - Public Hearin~ - 7:00 P.M. <br /> <br /> Mr. Marshall presented Petition 96-03 by Ferrell and Betty James to rezone <br />two parcels totaling approximately four acres on Roberts Road at Coddle Creek <br />(Map/PIN 5518-39-0859 and 5519-20-9094) from Medium Density Residential to High <br />Density Residential. The Planning and Zoning Commission had voted 5 - 2 to <br />recommend approval; however, the vote did not meet the 75 percent requirement or <br />"super majority'. Mr. Marshall presented'a map showing the location of the <br />property and listed the permitted uses for the High Density Residential zone. <br />He explained that the requested zoning would permit 18 units per acre; however, <br />he estimated that only two acres would be bulldable land due to the location of <br />the floodplain. The detailed findings and compatibility with other Ordinances <br />and Resolutions were as follows: <br /> <br />This property falls within the area of the Western Area Plan. <br />It is designated for medium density residential.
