conditions by the County to be kept and performed, the County have quiet and undisturbed and continued possession of the Premises, free from any claims by the City and every perso~ entity claiming under, by, or through the City. The City shai] encumber the Demised Premises or permit the Demised Premises encumbered except as first consented to by the County. /%RTICLE VIII Miscellaneous Section 8.01: Force Majeure. If the City or the County delayed in, hindered in, or prevented from the performance of act required hereunder by reason of strikes, lockouts, l.s~i%~i¥ troubles, inability to procure materials, failure of p~i~i~ restrictive government laws or regulations, riots, insurrec~;~c~., war, or other reason beyond its control, then performance of sued act shall be excused for the period of the delay; and the peric~d for the performance of any such act shall be extended for a peri©~ equivalent to the period of such delay hindrance, or preventio~ ~ the case may be. Section 8.02: Covenants Runninq with Land. Ail covenant~! promises, conditions, and obligations herein contained or imp]ie~:~ by law are covenants running with the land and shall attach to Demised Premises and shall bind and inure to the benefit of County and the city and their respective heirs, lega? representatives, successors, and permitted assigns. Section 8.03: ~o Waiver. No waiver of a breach of any of ~ covenants in this Lease contained shall be construed to be a waiv~ of any succeeding breach of the same covenant. Section 8.04: Memorandum of Lease. The County and the Ci%v may, upon the commencement of the term of this Lease, execut~ ~. memorandum of lease legally sufficient to comply with thc provisions of the North Carolina General Statutes relating thereto~ If prepared, said memorandum of lease shall include provisions relating to: (i) names of the parties to this Lease; (ii) ~ description of the Demised Premises; (iii) the term of this Leas.~:~ and (iv) incorporation of this Lease. Section 8.05: Notices.
