-2- <br /> <br /> In order to update our records we request that the governing <br />body do the following two things: <br /> <br />(!) Enact a resolution (or use the attached Resolution, if <br />_ you wish) at its earliest convenience, designating the official who <br />will not only make written recommendations to the Commission on <br />each ABC permit application, but who will also be responsible for <br />testifying as to the city's or county's recommendation at any <br />hearings which may be conducted before the Office of Administrative <br />Hearings. <br /> <br />NOTE: In making this designation by resolution, this official <br />will become the official with the authority to testify at <br />hearings requested by applicants who are denied permits <br />because of "local government objections" pursuant to G.S. 18B- <br />904(f). <br /> <br />Other local officials may testify regarding underlying facts <br />related to suitability, but the official designated by <br />resolution is the only official who may state the position and <br />opinion of the city or county regarding the applicant or <br />location. <br /> <br /> (2) Complete the additional enclosed form to indicate names, <br />addresses and telephone numbers of the various officials listed on <br />the form. This information will aid the Alcohol Law Enforcement <br />Division and the Commission as it gathers other relevant <br />information on the suitability of a location to hold ABC permits. <br /> <br />Please have responses completed and returned to us no later <br />than October !5j 1994, and please feel free to contact me at (919) <br />779-0700 if you have any questions.
