Box 707
Concord, North Carolina 28026-0707

Dear Mr. Little:

The requirements for a limited food service establishment, i.e., a ballpark
concession stand, have changed. Most of the changes are cosmetic in nature
and compliance will pose no problems for any of the existing concession
stands. However, these rules do not allow any limited food service
establishment to be open for more than 60 days in any calender year.
Undoubtedly, this requirement will be impossible for most concession stands to
meet. This reqirement is especially difficult for those concession stands
operated by two or more non-profit groups who use the same stands at
different times. The 60 day time limit is applicable to the concession stand
and not the group. This needs to be changed. In addition, most concession
stands operate fewer than four hours per day. Consequently, it would take
120 days for most of these establishments to equal 60 days of 8 hour
operation. For this reason alone, the time limit should be extended to at least
120 days.

I hope these comments are helpful to you and your Board. If you need any
further assistance please contact me.

With best regards,

William F.
