Since the business could continue to operate on the site as a nonconforming use <br />without the rezoning, and since that seems to be the owner's intention, the staff <br />now believes that the adjacent property owners concerns could best be <br />addressed by rezoning the property and applying conditions which address <br />their concerns. <br /> <br />Staff recommends that based on the following facts these conditions be applied. <br />The petitioner must agree to each condition for it to be valid. <br /> <br />Face The petitioner has submitted a development plan showing general use of <br /> the property. <br /> <br />Condition: That the petitioner adhere to his submitted development plan. <br /> <br />Face The petitioner has indicated that standard hours of operation are from 8 <br /> a.m. to 5 p.m. with one truck currently leaving at 6:30 a.m. <br /> <br />Condition: That hours of operation be limited to the period between 6 <br />a.m. and 5:30 p.m. Monday through Saturday, and 12 noon to 5:30 p.m. <br />Sundays except in the case of documented emergencies. <br /> <br />Face The petitioner has stated his intent to provide a paved apron to lessen <br /> dust and debris at the entrance. <br /> <br />Condition: That a paved apron be constructed at the drive access onto <br />Robinson Church Road, and that this paved area be 20' wide and 25' long. <br /> <br />Fac~ The petitioner has shown a proposed office site and alternative office site <br /> on the development plan. <br /> <br />Fac~ The surrounding area is zoned residential and developed residential. <br /> <br />Condition: That any new office meet N.C. Building Code and be located <br />on the alternate site with landscaping on the side facing Robinson Church <br />Road. <br /> <br />Alternative Condition: That any new office meet N.C. Building Code and <br />have a brick facade on the side facing Robinson Church Road with <br />additional landscaping on that side. <br /> <br />Face The surrounding zoning permits business signs for home based <br /> businesses that can not exceed eight square feet. <br /> <br />Condition: That the sign for the business not exceed 50 square feet. <br /> <br /> <br />
