.Pharr Realty, /nc. <br /> <br />August 21, 1995 <br /> <br />Mr. Jeff Barnhardt, Chairman <br />Cabarrus County Board of Commissioners <br />PO Box 707 <br />Concord, NC 28026 <br /> <br />Dear Mr. Barnhardt: <br /> <br />We wish to file an appeal of the ruling made by the Cabarrus County Planning <br />and Zoning Commission in the matter of Petition 95-06. Enclosed please find a <br />check for the required $75.00 advertising fee. <br /> <br />We became awa~e of the request for change some 36 hours before the hearing, <br />therefore had insufficient time to prepare for the process. After review/ng the <br />documentation presented in this matter and examining current land use, we <br />believe this decision was unwise. <br /> <br />Item 1 on the cover page of Jonathan Marshall's packet indicates that all GI <br />(General Industrial) uses must be considered prior to changes. While many of <br />the uses listed for General Industrial could be compatible with the surrounding <br />area, some are not. Examples of incompatible uses include, but are not limited <br />to, Chemical Manufacturing, Foundries, Slaughter House and Warehouse, Volatile <br />materials. Current land use within the hnmediate area should preclude these <br />without extremely close scrutiny of the installation, however changes approved <br />on August 17, 1995 will permit unrestricted development without regulatory <br />controls. <br /> <br />Within one-haif (1/2) mile of the questioned property the preponderance of <br />property is zoned HDR (High Density Residential). SeveraI densely populated <br />areas presently are located within close proximity. Property immediately adjacent <br />on the east side is zoned industrial, however restrictions remain on this use. <br /> <br />Please also note that my attempt to speak at the hearing was obstructed by the <br />fact that the front doors for the Administration Building, where the hearing was <br />held, remained locked during at least 30 minutes of the meeting, thereby forcing <br />me to seek an alternative way inside. Having found an alternative route, I <br />arrived just after a vote was taken in this matter.
