Planning and Zoning Commission Minutes <br />August 17~ 1995 <br /> <br />Page 10 <br /> <br />Mr. Gerald Newton, Director, addressed the Board stating that we <br />would love to do that, however, the Zoning Administrator is not <br />allowed to review something without such standards. That is <br />when it becomes a Board of Adjustment case. What you are <br />proposing, we certainly would like to do, but it is considered and <br />passed by the courts as being arbitrary when you do not have set <br />standards for him to make his determination from. <br /> <br />There being no further comments, Mr. Jeter MOTIONED to <br />approve Zoning Text Revision - Section 4-19, Access Points as <br />submitted, seconded by Mr. Ritchie. The vote was unanimous. <br /> <br />The Chair said this revision is approved, and it will go on to the <br />Board of Commissioners at their September 18, 1995 meeting for <br />their approval. <br /> <br />Director's Report <br /> <br />Mr. Newton said he has two items that he would like to talk about. He said the <br />first one is really just turning it back over to Jonathan. Fie said as the Board <br />knows, every two years we are suppose to be looking at our zoning ordinance <br />and updating it. That is what the staff has been doing on some text amendments <br />and some map amendments. Mr. Newton said there is another area that we <br />have bc~n looking at for some time that we would like to present to the Board, <br />not for action, but rather just to open the discussion about what we will probably <br />be bringing back next month for consideration as an administrative rezoning, <br />similarly to what we have done around the Westside Bypass and Lane Street <br />area. He then turned the discussion over to Mr. Marshall. <br /> <br />Mr. Marshall addressed the Board stating he would like to tell the Board that we <br />are moving on to the other two because we are completely finished with the first <br />two, but we are not, because we still have one of those ongoing. It will be heard <br />by the Commissioners in September. Mr. Marshall then talked to the Board <br />about the other two areas of administrative rezoning. <br /> <br />Mr. Newton said the Board will be hearing more on that as we present it at the <br />September meeting. <br /> <br />Mr. Newton said the second item which also deals with this bi-annual review, <br />deals with Section 6-11 of the Zoning Ordinance.
