CABARRUS COUNTY CODE <br /> <br /> tions governing category IV air ambulances; <br /> providing, however, that such air ambu- <br /> lance shall not provide prehospital emer- <br /> gency medical service within the county un- <br /> less requested by and coordinated with the <br /> county emergency medical service. <br />(Ord. of 9-4-90, §§ 2, 15) <br />Sec. 82.52. Application. ~ <br /> Applications for a franchise to operate ambu- <br />lances in the county pursuant to this article shall <br />be made upon such forms as may be prepared or <br />prescribed by the county and shall contain: <br /> <br /> (1) The type of franchise requested, either non- <br /> emergency ambulance service or emergency <br /> ambulance service. <br /> <br /> (2) The name and address of the applicant. <br /> <br /> (3) The name under which the applicant does <br /> business or proposes to do business along <br /> with a certified copy of any articles of in- <br /> corporation, partnership agreement, certif- <br /> icate of limited partnership, or assumed <br /> name certificate. <br /> <br /> (4) The training and experience of the appli- <br /> cant in the transportation and care of pa- <br /> tients. <br /> <br /> (5) A description of and copy of the state cer- <br /> tification for each ambulance operated by <br /> the applicant. <br /> <br /> (6) A copy of the state certification for each <br /> emergency medical technician employed by <br /> the applicant. <br /> <br /> (7) The location and description of the place <br /> from which it is intended to operate. · <br /> <br /> (8) Audited or unaudited financial statements <br /> of the owner's operations in the county, in <br /> such form and in such detail as may be re. <br /> quired by the county. <br /> <br /> (9) Any other information the county shall <br /> deem reasonably necessary for a fair deter- <br /> ruination of the capability of the applicant <br /> to provide ambulance service in the county <br /> in accordance with the requirements of state <br /> law and the provisions of this article. <br /> of 9-4-90, § 3) <br /> <br />(Ord. <br /> <br />Sec. 82.53. Hearing, investigation, standards~'~'' <br /> for granting. <br /> <br /> (a) Upon receipt of an application for a iran- <br />chise, the board shall schedule a time and place <br />for a hearing on the application. <br /> <br /> (b) The county shall, prior to the hearing, cause <br />such investigation as is deemed necessary to be <br />made of the applicant and its proposed operations. <br /> <br /> (c) A franchise shall be granted if the board <br />finds all of the following: <br /> <br /> (1) The public convenience and necessity re- <br /> quires the proposed ambulance service. <br /> <br /> (2) Each such ambulance and its required <br /> equipment have been certified by the state <br /> as acceptable for the type of franchise re- <br /> quested. <br /> <br /> (3) The applicant or its officers or partners are <br /> responsible persons to conduct or work in <br /> the proposed business. <br /> <br /> (4) Only duly certified emergency medical tech- <br /> nicians are employed as operators and at- <br /> tendants by applicants for an ambulance <br /> service franchise. <br /> <br /> (5) That all the requirements of this article and <br /> all other applicable laws and ordinances <br /> have been met. <br />(Ord. of 9-4-90, § 4) <br /> <br />Sec. 82.54. Geographical boundaries. <br /> <br /> The franchise shall state the geographical <br />boundaries, if any, of the area for which the fran- <br />chise is granted. With six months' written notice <br />to the franchised operator, the board may alter <br />the geographical boundaries of the franchise.' <br />(Ord. of 9-4-90, § 5) <br /> <br />Sec. 82-55. Change in ownership or manage. <br /> merit. <br /> <br /> Any change of ownership or management of a <br />franchised ambulance provider shall te;minate the <br />franchise and shall require a new application and <br />a new franchise and conformance with all the re- <br />quirements of this division as upon original fran- <br />chising. <br />(Ord. of 9-4-90, § 6(b)) <br /> <br />CD82:10 <br /> <br /> <br />
