NORTH CAROLINA <br /> <br />CABA~RUS COUNTY <br /> <br />PETITION TO CLOSE PubLIC ROAD/EASE/~NT <br /> <br /> THE UNDERSIGNED does hereby request the Board of Commissioners <br />of Cabarrus County (the "Board") to adopt a resolution declaring <br />its intent to close a portion of a public road/easement and, <br />pursuant to N.C.G.S. 153A-241, to call a public hearing on said <br />question, and in support of said petition shows unto the Board <br />that: <br /> <br /> · 1. The Petitioner is the sole property owner abutting <br />Northside Avenue for a distance of 243 feet west of its <br />intersection with Broadway Street (S.R. 1111), in No. 10 Township, <br />Cabarrus County, Midland, North Carolina, as shown on the map <br />attached hereto (hereinafter the 243-foot length of Northside <br />Avenue sought to be closed is identified as the "Road/Easement"). <br /> <br /> 2. The Road/Easement, first identified in Map Book 1, page <br />21 and 45, Cabarrus County Registry, including the Road/Easement <br />has never been opened. <br /> <br /> 3. The Petitioner requests that the Road/Easement be closed <br />to the public. <br /> <br /> 4. No individual or entity owning property in the vicinity <br />of the Road/Easement, or in the subdivision in which it is located, <br />will be deprived of means of ingress and egress, and the closing of <br />the Road/Easement is not contrary to the public interest. <br /> <br /> 5. The Petitioner has agreed to reimburse the County for all <br />expenses incurred by its incident to the hearing, including, but <br />not limited to, the expenses of gdvertising therefor. <br /> <br />NOW, THEREFORE, the Petitioner prays that: <br /> <br /> 1. The Board adopt a resolution declaring its intent to <br />close the Road/Easement and a public hearing be held on the <br />question. <br /> <br /> 2. The Board direct that a notice of the proposed closing <br />and public hearing thereon be prominently posted in at least two <br />(2) places along the Road/Easement, and that the resolution be <br />publisheQ in a newspaper of general circulation in Cabarrus County <br />once a week for four (4) consecutive weeks before the hearing. <br /> <br /> 3. Subsequent to hearing on the question, the Board issue an <br />Order closing the Road/Easement, and the Order be filed in the <br />Office of the Register of Deeds of Cabarrus County. <br /> <br /> <br />
