He said they plan no further construction. It is a simple matter to <br />abandon should there become more beneficial uses to the property at some later <br />date. They did not want to tie it to an airstrip use only. <br /> <br />Mr. Amos asked Mr. Marshall about the letter from Juanita Smith, from the U.S. <br />Department of Transportation, they gave restrictions relative to proximity of the <br />runway to near by roads and such, is this the responsibility of Mr. Laney, the <br />owner, to ensure that that takes place, or is that his responsibility, and if it is his, <br />has he verified that these distance restrictions have been met. <br /> <br />Mr. Marshall said that would be the FAA responsibility and Mr. Laney to ensure <br />to them. <br /> <br />Mr. Laney said that was the State's concern before issuing the permit. He said <br />this has been a long drawn out process for over two years to get to this point. <br />Mr. Laney said the answer to Mr. Amos question is that the State has satisfied <br />themselves to that extent by issuing their permit after the Federal. <br /> <br />The Chair asked Mr. Laney if he would agree to these conditions. <br /> <br />Mr. Laney said yes, he agrees to those 3 conditions. <br /> <br />There being for further comments, the Chair closed the public hearing on Petition 93-11, asking <br />if anyone would have a motion concerning this petition. <br /> <br />Mr. Amos MOTIONED to approve Petition 93-11 with the 3 conditions as stated: <br /> <br />The airstrip use will be limited to no more than 5 <br />separate ultralights (as defined by the FAA), <br /> <br />Flight hours will be limited the between 30 minutes <br />before sunrise to 30 minutes after sunset, and <br /> <br />3. The airstrip will remain grass only. <br /> <br />The motion was seconded by Mr. Jordan and the vote carried unanimously. <br /> <br /> <br />
