Destruction: When a nonconforming structure is destroyed or seriously damaged <br />and the repair costs for it equal or exceed 75 percent or more of its tax assessed <br />value, it must, if reconstructed, conform in all ways. Caiculation of the cost of <br />damage will be that determined by the owner/operator's insurance carrier. If <br />uninsured or no insurance claim is filed, the amount of damage will be estimated <br />by a County Tax Assessor Office appraiser. <br /> <br />This change clarifies the intent of the Chapter as it would have been applied <br />through the Certificate of Nonconformity Adjustment but is much more specific. <br /> <br />The Planning and Zoning Commission voted 9-0 to approve this zoning text <br />amendment. <br /> <br /> <br />
