When the Board of Commissioners <br />approves payment of overtime in lieu of compensatory time, payment shall be at <br />the regular rate earned by uqe ..... 7)]o~:,. at the time the employee receives such <br />payment. <br /> <br /> Employees who have accrued compensatory time shall, upon termination of <br />employment, be paid for the unused compens:~to,'-y time at a rate of compensation <br />equal to: <br /> <br />(a) the average regular rate received by the employee during the last <br /> three years of the er::pk>yee's employment, or <br /> <br />(b) the final regular rate received by the employee, whichever is greater. <br /> <br /> Any employee who has requested the use of accrued compensatory, time off <br />shall be permitted to use the time with!n a reasonable period after the request, <br />as long as such use does not ,.m. ciulv disrupt the operations of the public agency. <br />Such determination shall be based on the facts and circumstances of each <br />individual case. <br /> <br /> Any employee, not withstanding emergency medical service and law <br />enforcement personnel, who works on holidays, Saturdays, or Sundays or before <br />or after the normal working day but does not work over the established number <br />of hours for that work period because of holiday, annual leave or sick leave, may <br />receive compensatory time oft' at an .hour-t:or-hour exchange. <br /> <br /> Excluding the County Manager, elected officials and department heads, any <br />employee who is exempt from the FLSA minimum wage and overtime <br />compensation requirements may be _~ranted compensatory time at the discretion <br />of the department head. Compensatory time for such employees shall not exceed <br />an hour-for-hour exchange for all hours worked over 40, or over 171 for law <br />enforcement personnel, in the work period. Accrt~ed compensatory time for such <br />employees shall be k)rfei:ed at the empioyee's termination of employment. <br /> <br />SECTION 7.
