__ LOSTTI]~ECONTROL P03 <br /> <br />No letter nor any form of communication has ever taken <br />place between LOS~ Time Control and Cumberland County. <br />A letter was sent to Mr. Joel Has,burn of Iredell <br />County which relate~ inEorma=ion that the loss <br />experience o~ Cumberland County had been much tha~ %hey <br />were non renewed or forced i~to self insurance. It was <br />no~ the intent of ~e writer to relate this ab fact~ <br />b~t rather as hear-say. However, the wording in the <br />letter was improper and it came across as fact. The <br />information was never factually veri£ie~ and c~me from <br />a County Manager who had indicated he did not wish to <br />be a part of any association whic~ included Cumberland <br />County, due to there loss experience. The repo~c~ng of <br />information as fact, was an error on the part of Lost <br />Time Control. <br /> <br />(6). There was recently legislation passed which makes it <br /> possible to reopen a ca~e after many yea=e, o~ to bring <br /> a Gl&i~ Which may be many years old and had never been <br /> repo~ced, please comment. <br /> <br />I know of no legislative effort tO achieve ~he above, <br />~owever t~ere was a Supreme cour~ cede which ca~e down, <br />I believe in the summer Of.199~, w~lch in effect give~ <br />life time mediG~l bens=its to a case. This i~ a change <br />fro~ prior handling, in that before bene£i=s were <br />~9~t~nued for a period o£ two years £rom th~ date cf <br />last compensation. Now, i= is possible to h~ve medical <br />benefits for life. <br /> <br />Under the self insured plan, all claims wi~ a daks of <br />~njury ~rior =o July 1, 19~4 would be the <br />responsibility of the County Associ~tion or whom ever <br />you might have been insured at the time. Cabarrus <br />County would o~ly be responsible for ~he cost <br />associated with claims having dates of injury o£ July <br />1, 1994 or gre~ter. I might add, the Supreme Court <br />ruling is highly controversial and would ef£ect only a <br />small percent of claims. <br /> <br /> <br />
