NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br /> AMENDMENT NO. 1 <br /> <br /> TO <br /> <br /> INTERIM OPERATION AGREEMENT <br /> <br /> WHEREAS, the CITY OF CONCORD, a municipal corporation (hereinafter referred to <br />as "Concord"); CABARRUS COUNTY, apo. litical subdivision of the State of North Carolina <br />(hereinafter referred to as 'ICabarrus"); and the WATER AND SEWEI( AUTHORITY OF <br />CABARRUS COUNTY, a public corporation of the State of North Carolina (hereinafter referred <br />to as the ".Authority"); have entered into an agreement entitled Interim Operation Agreement; <br />and <br /> <br /> · WHEREAS, Section 15 of the Agreement provides that such may be amended or <br />modified, in whole or in part, by an agreement in writing executed' in the same manner as the <br />Agreement and approved by Vote by majority of members of each of the respective governing <br />boards of Concortt, Cabarrus and the Authority; and <br /> <br /> WHEREAS, Concord and Cabarrus have agreed to complete the transfer of the <br />opei'ations facilities in accordance with this Agreement and the Settlement Agreement dated <br />January 6, 1992, by and between Concord and Cabarrus; ahd. <br /> <br /> WHEREAS, the complete transfer of the facilities is to 'be co.mpleted when the <br />Environmental Protection Agency and the State of North Carolina Division of Environmental <br />Management have agreed to transfer Grants, 04 and 05; and <br /> <br /> <br />
