(D) <br /> <br />Cost of the audit required by this section may be charged against the <br />Weatherization Assistance Program on a pro rata basis as WAP funds relate to <br />total contractor funds audited. <br /> <br />Section 8: Contract Changes. Any proposed changes in this contract shall be in <br />writing, submitted to and approved and executed by the Grantee before performance of <br />any work involved in the proposed change. <br /> <br />Section 9: This agreement is subject to and incorporates the attached Parts II and Ill, as <br />if written word for word herein. <br /> <br />Section 10: The Contractor agrees to assist the Grantee in complying with all of the <br />Conditions Governing Grants under the National Energy Conservation Policy Act. <br /> <br />Section 11: The continued performance of this contract by the Grantee is dependent <br />upon the availability of funds for this purpose and the contractors ability to carry out the <br />purpose of the Weatherization Assistance Program as prescribed in the North Carolina <br />WAP State Plan, as well as, consistent with Part II Section 1 of this agreement. Should <br />funds for this purpose cease to be available, this contract shall automatically terminate. <br /> <br />Section 12: Honesty and Fidelitv Bonds. The Contractor shall maintain throughout the <br />duration of this Contract a Honesty and Fidelity bond that protects the program against <br />theft, damages, or other abuses that may occur while this contract is in force. Such <br />Honesty and Fidelity bonds should be at least 15% of the total funds awarded under this <br />Contract. The Grantee recommends that the contractor also maintain liability insurance <br />to protect against personal injury and property damage sustained during weatherizaiton <br />activities. <br /> <br />Section 13: Residential Energy Conservation Assistance Programs Manager (RECAP) is <br />designated as "Contract Administrator" with the responsibilities of monitoring the <br />activities of the contractor with respect to its implementation of the program in <br />accordance with the provisions outlined in parts I, II and III, and in certifying that work <br />has been performed before invoices are paid. <br /> <br />Section 14: Th~- Contractor certifies that neither the organization nor any of its <br />principals is presently debarred, suspended, proposed for debarment, declared ineligible, <br />or voluntarily excluded from participating in this Agreement by any Federal department <br />or agency. <br /> <br />Section 15: The Contractor certifies that it will comply with prohibitions and <br />requirements for disclosure and certification related to lobbying on recipients of Federal <br />contracts, grants, cooperative agreements, and loans as .contained in the Federal <br />Register 10CFR 601. <br /> <br />Section 16: Agreements in ~ of $100,000. -All applicable standards, orders, or <br />requirements issued under Section 306 of the Clear Air Act (42 U.S.C. 1857(h), Section <br />508 of the Clean Water Act (33 U.S.C. 1368), Executive Order 11738, and <br />Environmental Protection Agency regulations (40 CFR Part 15) must be adhered to. <br /> <br /> <br />
