§ 1-2 <br /> <br />CABARRUS COUNTY CODE <br /> <br /> Owner. The term "owner," when applied to a <br />building or land, includes any part owner, joint <br />owner, tenant in common, joint tenant or tenant <br />by the entirety of the whole or part of such building <br />or land. <br /> <br /> Person. The term "person" includes a corpora- <br />tion, firm, partnership, association, organization <br />and any other group acting as a unit, as well as an <br />individual. <br /> <br /> Personal property. The term "personal property" <br />includes every species ofproperty except real prop- <br />erty. <br /> <br /> Preceding, following. The terms "preced/ng" and <br />"following" mean next before and next after, re- <br />spectively. <br /> <br /> Property. The term "property" includes real and <br />personal property. <br /> <br /> Realproperty. The term "real property" includes <br />lands, tenements and hereditaments. <br /> <br /> Residence. The term "residence" means the <br />place adopted by a person as his place of habita- <br />tion and to which, whenever he is absent, he has <br />the intention of returning. When a person eats at <br />one place and sleeps at another, the place where <br />such person sleeps shall be deemed his residence. <br /> <br /> Right.of-way. Except with respect to vehicle and <br />traffic regulations, the term "right-of-way" means <br />land that is dedicated or otherwise legally estab- <br />lished for public use. <br /> <br /> Roadway. The term "roadway" means that por- <br />tion of a street improved, designed or ordinarily <br />used for vehicular travel, exclusive of the shoulder. <br />If a street includes two or more separate road- <br />ways, the term "roadway" refers to any such <br />roadway separately but not to all such roadways <br />collectively. <br /> <br /> Shall, may. The term "shall" is mandatory and <br />not merely directory; the term "may" is permis- <br />sive. <br /> <br /> Sidewalk. The term "sidewalk" means that por- <br />tion of the street right-of-way which is improved <br />and designated for the use of pedestrians. <br /> <br /> Signature, subscription. The terms "signature" <br />and "subscription" include a mark where a person <br />cannot write. <br /> <br /> State. The terms "the state" and "this state" <br />mean the State of North Carolina. <br /> <br /> Street, highway. The term "street" means the <br />entire width between property or right-of-way lines <br />of every way or place of whatever nature, when <br />any part thereof is open to the use of the public as <br />a matter of right for the purposes of vehicular <br />traffic. The terms "highway" and "street" shall <br />be used synonymously. <br /> <br /> Tenant, occupant, The terms "tenant" and <br />"occupant," applied to a building or land, include <br />any person who occupies the whole or part of such <br />building or land, whether alone or with others. <br /> <br /> Tense. Words used in the past or present tense <br />include the future as well as the past and the <br />presenl. <br /> <br /> Written, in writing. The terms "written" and <br />"in writing" shall be construed to include any <br />representation of words, letters or figures, whether <br />by printing or otherwise. <br /> <br /> Year. The word "year" means 12 consecutive <br />months. <br /> State law reference-Similar provisions, G.S. 12-3, 20. <br />4.01. <br /> <br />Sec. 1.3. Provisions of Code considered con. <br /> tinuations of existing ordinances. <br /> <br /> The provisions appearing in this Code, so far as <br />they are the same as those of prior county ordi- <br />nances, shall be considered as continuations <br />thereof and not as new enactments. <br /> State law reference-Similar provisions applicable to state <br />statutes, G.S. 153A-2. <br /> <br />Sec. 1-4. Repeal, expiration and revival of or- <br /> dina_rices. <br /> <br /> (a) The repeal of an ordinance, or its expiration <br />by virtue of any provisions contained therein, shall <br />not affect any right accrued, any offense com- <br />mitted, any penalty or punishment incurred or <br />any proceeding commenced before the repeal took <br />effect or the ordinance expired. <br /> <br />CDI:4 <br /> <br /> <br />
