Wood, Jr., Judge Presiding, of Cabarrus <br />County, North Carolina, upon motion of the plaintiff and defendants <br />for final judgment by consent; <br /> <br /> AND IT APPEARING TO THE COURT that the plaintiff has been <br />represented herein by Richard/M. Koch, Esquire and Fletcher L. <br />Hartsell, Jr., Esquire, and the defendants have been represented by <br />David L. Henderson, Esquire; <br /> <br /> AND THE COURT, having considered the pleadings and by and with <br />the consent of the parties affixed hereto, does hereby make and <br />enter the following <br /> <br /> FINDINGS OF FACT: <br /> <br /> 1. This action .was duly instituted on the 12th day of <br />August, 1992, by the issuance of summons and the filing of a <br />complaint, declaration of taking and notice of deposit, along with <br />the deposit into the Court of the sum of One Hundred Seventy-Three <br />Thousand Five Hundred Dollars ($173,500.00), the sum estimated by <br />the plaintiff to be just compensation for the taking of the <br />property of the defendants. <br /> <br /> 2. The summonses, together with copies of the complaint, <br />declaration of taking and notice of deposit, were duly served upon <br />the defendants, as appears of record. <br /> <br /> 3. Ail persons having or claiming to have an interest in the <br />condemned property are parties hereto and are duly before the <br />Court. <br /> <br /> <br />
