[CABARRUS <br /> <br />January12, 1993 <br /> <br />MEMORANDLTM <br /> <br />TO: Cabarrus County Board of Commissioners <br /> <br />FROM: Cable Franchise Commission <br /> <br />SUBJECT: Violations of Cable TV Franchise Agreement <br /> <br /> In the course of its deliberations, the Cabarrus County Franchise Commission has <br />found that some provisions of the Franchise Agreement have not been followed. Though <br />no written records exist in County offices, apparently there was a tacit understanding <br />between County officials and the Vision Cable management that various reports called for <br />in the Franchise Agreement were not to be made unless specifically requested. Nonetheless, <br />the Franchise Agreement requires the reports to be made. <br /> <br /> Therefore, the Commission, in the absence of evidence of any formal action to <br />amend the reporting requirements, must conclude that Vision Cable of Metrolina is in <br />violation of several sections of the Cabarrus County Cable Television Ordinance as is <br />specified below. Hopefully, the notification of violations will insure that all reporting <br />requirements will be met in the future. <br /> <br />1) Section 8.2 Payment to the County <br /> <br />The Commission finds that the report received from Vision Cable <br />accompanying the quarterly payment does not meet the requirements of this <br />section which calls for a certified report. In the opinion of the Commission, <br />the report should contain a statement to the effect that the report is a <br />complete and accurate account of the gross receipts and should be signed by <br />the general manager. <br /> <br />2) Section 12.4 Complaint Log <br /> <br />The Commission finds no past or present summary of the number and types <br />of complaints received. <br /> <br /> Office of the County Manager <br /> <br />P.O.
