Memorandum <br />March 31, 1993 <br />Page -2- <br /> <br />In the Kannapolis Land Development Strateq¥, the importance of this <br />land area is noted and the document recommends that with annexation <br />that a plan be prepared for the area which would detail major <br />streets, water, sewer, and other municipal facilities components. <br />It also recommends three other actions two of which are road <br />improvements which our office handles in Transportation Planning <br />and would continue to handle regardless of annexation or etj. The <br />third recommendation is for a public improvements program for the <br />area as would be customarily created for any annexed area. <br /> <br />There is no doubt that this area is of importance to Kannapolis, <br />but it is questionable as to what value would be achieved in <br />granting etj where all regulatory activities are already in place <br />and effective planning and plans already exist. Portions of the <br />more detailed plans of certain future road improvements and <br />infrastructure improvements can be made without granting etj. By <br />General Statute much of this is to be done prior to granting etj <br />and it is to be a part of the annexation package. <br /> <br />The county has had zoning since 1982, and since that time period no <br />relinquishing of zoning or subdivision regulations has occurred or <br />any of the other items that are lost if etj is granted. The <br />relinquishing has only occurred with annexation or subsequent to <br />incorporation. That is sound policy. <br /> <br />Finally, the Board should also understand that granting <br />extraterritorial jurisdiction includes relinquishing 12 powers. <br />They are zoning, subdivision regulation, minimum housing <br />regulations, enforcement of State Building Code, establishment of <br />Historic Districts, jurisdiction of Historic Properties Commission, <br />community development powers, jurisdiction of community appearance <br />commission, acquisition of open space, soil erosion and <br />sedimentation control, mobile home park ordinance, and floodway <br />ordinances. Only those items exercised within the city limits may <br />be exercised in the extraterritorial boundaries. Several of the <br />items in the list would probably not be exercised. Several others <br />would need some form of interlocal agreement for the County to <br />continue to provide the service. <br /> <br />I trust this information will be of some technical assistance to <br />you as you consider the request. <br /> <br />Attachment <br /> <br /> <br />
