Box 707 <br />77 Union Street <br />Concord, NC 28025 <br /> <br />I-DR <br /> <br />Re: Midland/Wallace Road Water Distribution Facilities <br /> Railroad Encroachment <br /> HDR Project No. 00187-043-018 (CA) D <br /> <br />Dear Mr. Witherspoon: <br /> <br />The above project includes a crossing of the Aberdeen, Carolina & Western Railway line near its <br />intersection with US 601. We have reviewed the project with the railway and they have proposed <br />that the District execute the enclosed License for Underground Installation, and return along with <br />a check in the amount of $1,500.00 as a one time fee. <br /> <br />The agreement has been reviewed by Fletcher Hartsell. He said that it was a fairly standard format. <br />His only question was in reference to paragraph 4, whether the costs for the railway personnel on <br />site is included in the $1,500 fee. We were informed this morning that this requirement is only for <br />conditions when the contractor is digging within 10 feet of the tracks. In our casE, the excavation <br />will be at least 25 feet from the tracks and thus will not require the extra railway personnel. <br /> <br />If at all possible, we need to have four copies of the Agreement executed as soon as possible and <br />returned with the fee to the railway. The Contractor will complete all other work by the end of the <br />day Wednesday, and may have to demobilize. Obviously, this is a matter that should have been <br />taken care of prior to bidding, but I apparently did not follow through after receiving Fletcher's <br />comments last December.
