Halite Kachlne <br />Company, inc., now or foruerly, with the proposed northern right of way <br />boundary of the project, said point being 100 Pt. north of and normal to <br />Survey Line L-Rev.; thence in un easterly direction in a straight line <br />100 Ft. north of and parallel to Survey Line L-Rev. to the point of <br />intersection with the eastern property line of the undersigned, a common <br />property line with Frank Mullis, now or formerly; thence along and with <br />the eastern property line of the undersigned and the eastern property <br />line, If extended In a southerly direction to the point of intersection <br />with Survey Line L; thence In a westerly direction along and with Survey <br />Line L to the point of Intersection with the western property line, if <br />extended of the undersigned; thence tn a northerly direction along the <br />western property line, If extended and the western property line of the <br />undersigned to the point of EEOINNING. <br /> <br />The property hereinabove described was acquired by the Grantors by <br />Instrument(o) recorded tn the Cabarrus County Registry tn Deed Book 596 , <br />Page 391. <br /> <br /> THE final right of way plans showing the above-described right of <br />way are to be certified and recorded tn the Office of the Register of <br />Deeds for enid County pursuant to N.C.g.S. 136-19.4, reference to which <br />plans I8 hereby nade for purposes of further description. <br /> <br />THIS deed is subject to the following provisions only: <br /> <br /> We, the undersigned property owners, reques~ that the Department enter upon <br />our lands outside of the right of way to the e~ent es ~o necesear~ to reconnect <br />our driveway and we will have no cl~,~m,,~ for damages as a FemLlt of the <br />reconnec~on of said driveway. <br /> <br /> TO RAVE AND TO HOLD the aforesaid right of way and all <br />privileges and appurtenances thereunto belonging to the DEPARTMENT tn FEE <br />SIMPLE. <br /> <br /> The GRAHTORS by the execution of thio Instrunent, acknowledge that <br />the plans for the aforesaid project as they affect their property have <br />been fully explained to them or their authorized representative. <br /> <br /> AND the GRANTORS covenant with the Department, that the GRANTORS are <br />seized of the premises tn fee simple, have the right to convey the sane <br />tn fee simple, that the title thereto is marketable and free and clear of <br />all encumbrances, and that the GRANTORS will warrant and defend the title <br />against the lawful claims of all persons whomsoever except for the <br />exceptions hereinafter stated.
