Sec, 5. Nature of District; Governing Body. if created, the Poplar Tent <br />Beautification District shall be a body politic and corpo,'ate and may provide for the <br />beautification of thc district and protection of the citizens of the district b.y <br />developing and implementing the beautification plan and projects described ~n <br />Section I of this act. and may do all acts re~,sonably ,~cccssary to fulfill ti'tis purpose. <br />The governing body of the district may develop the beautification plan jointly with <br />the City of Concord or Cabarrus County planning and zoning departments, or may <br />consult with staff and use available resources within those departments, The <br />Cabarrus County Board of Commissioners shall serve, ex officio, as the governing <br />body of the district, and the officers of the board of county commissioners shall <br />likewise serve as the officers of the governing body of the district. A simple majority <br />of the governing body constitules a quorum, and approval by a majority of those <br />.present Is sufficient to determine any matter before the governing body, if a quorum <br />is present. <br /> Sec. 6. Comprehensive Land Use Plan; Advisory Commission. (a) If the <br />Poplar Tent Beautification District is created as provided in Sections I through 5 of <br />this act. the governing body of the district, at its first meeting, shall appoint an <br />advisory commission as provided in this section, for the purpose of developing a <br />comprehcnsivc land usc plan to bc al'~plicd ~,ithin thc tlistrict boundaries dcscribcd in <br />Section 2 of this act. The pus'pose of the comprehensive land use plan is to identify <br />appropriate land uses ;.~d to provide st~,bility within the district with respect to future <br />changes in land use. The advisory commission shall consist of seven members: three <br />members selected by the City of Concord Board of Aldermen, three members <br />selected by the Cabarrus Cou,3ty Board of' Commissioners. and one member selected <br />by the o~her six members of the i~dvis~r~, commission. Of the three members selected <br />respectively by the city and the county, one shall be an elected official and may be a <br />member of the respective governing board, and the other two .,,hall not be elected <br />officials but shall either reside or own property in the Poplar Tent Beautification <br />District. The advisory commission shall appoint a chairman from amo~ its <br />members, and the chairman shall vote only in case of a tie, <br /> (h) The advisory cornmi..,.'~ion shall hold public he,~rings, solicit comments <br />and recommendations for appropriate present and future land use within the ?oplar <br />Tent Beautification District. and shall develop a comprehensive land use plan <br />designating appropriate land uses for the District. After adoption of a plan by a <br />maiorJty of the members of the advisory commission, the plan shall be submitted to <br />the Cabarrus County Board of Commissioners, ~nd to the governing board of any <br />municipalit.v that is located entirely or partially within the District. or that exercises <br />zonin~ jurisdiction within the District. Upon submission of the plan to the governing <br />bodie~ as set forth in this subsection, those bodies may (i) adopt the plan, (ii) refer <br />the plan back: to the advisory commission with requested revisions, or (iii) take no <br />action on the plan; provid'ed that in order for the plan to become effective within the <br />entire District. an identical plan must be adopted by each of the local governments <br />exercising zoning jurisdiction within the District. If an identic~I plan is ~dopted by <br />each of those jurisdictions, the plan shall have the effect of a comprehensive plan in <br />the District and all land use within each jurisdiction within the District shall be <br />consistent with the comprehensive plan. After adoption under this section, the <br />comprehensive land use plan developed under this section shall not be changed or <br />repealed except upon a vote in favor of the specific change or repeal by ~, majority o1' <br />each of the govcrning~bodies of the jurisdictions that adopted the plan. <br /> <br /> <br />
