required by standard engineering practices, law, <br />regulations or other contractual agreement, the <br />owner of an Existing Line may require a party <br />seeking connection to install, at its sole <br />expense, a metering station at a location approved <br />by both KANNAPOLIS and CABARRUS at or near the <br />point of connection of the Proposed Line to the <br />Existing Line. The metering station itself shall <br />consist of metering equipment approved by both <br />KANNAPOLIS and CABARRUS. After connection, the <br />metering equipment shall be owned by, and shall be <br />maintained by the party providing service from the <br />point of connection; NOTWITHSTANDING the <br />foregoing, it is the desire and intent of <br />KANNAPOLIS and CABARRUS to minimize, if not <br />eliminate, the necessity for or usage of such <br />meters wherewer practicable. <br /> <br />7. Connection Fees. Except for any pre-existing contracts <br /> <br />or commitments of either KANNAPOLIS or CABARRUS which require <br /> <br />reimbursement of a portion of such fees collected, neither <br /> <br />KANNAPOLIS nor CABARRUS shall charge the other a fee for <br /> <br />connection to a water or sewer line of the other. (Insofar as <br /> <br />the parties are aware, the only such contracts or commitments <br /> <br />existing at the time of execution of this Agreement are those <br /> <br />attached hereto marked "Exhibit A" and incorporated herein by <br /> <br />reference. ) <br /> <br />8. Service Areas and Backflow Prevention: <br /> <br /> (a) Service areas for both CABARRUS and <br />KANNAPOLIS are defined and described in "Exhibit B" <br />attached hereto and incorporated herein by reference, <br />i.e. the Service Areas for the existing water and/or <br />sewer system in place at the time the agreement is <br />executed shall remain in effect. For existing or new <br />customers, neither KANNAPOLIS nor CABARRUS shall make <br />individual residential, commercial, and/or industrial <br />connections to the other system's water and/or sewer <br />lines, without the express, written permission of the <br />other. <br /> <br /> (b) New service areas are defined as those areas <br />where service would be provided by either party with <br /> <br />4. <br /> <br /> <br />
