(5) To the extent permitted by law and subject to any <br />obligations and covenants of the Authority, including any <br />obligations or covenants that the Authority may hereafter undertake <br />or make in connection with issuing bonds or entering into <br />installment payment contracts, any political subdivision joining <br />the Authority may petition for its dissolution if the capital <br />improvements program of the Authority, as generally outlined in the <br />feasibility study therefor prepared by J.N. Pease & Associates and <br />Ernst & Young, dated June 1990, is not substantially underway <br />within twenty (20) years from the date the Authority is organized; <br />and, in the event of such dissolution, the assets originally <br />transferred to the Authority shall be returned to the extent <br />possible to the political subdiwisions that transferred such assets <br />to the Authority and the remaining assets, if any, shall be <br />transferred to Cabarrus County, North Carolina. <br /> <br /> IN WITNESS W~EREOF, Cabarrus County, North Carolina has caused <br />these Articles of Incorporation to be executed by the Chairman of <br />its Board of Commissioners and its corporate seal to be affixed <br />hereto and attested by the Clerk to said Board, the City. of <br />Concord, North Carolina has caused these Articles of Incorporation <br />to be executed by its Mayor and its corporate seal to be affixed <br />hereto and attested by its city Clerk, the City of Kannapolis, <br />North Carolina has caused these Articles of Incorporation to be <br />executed by its Mayor and its corporate seal to be affixed hereto <br />and attested by its City Clerk, the Town of Harrisburg, North <br /> <br /> <br />
