between or among the part~es and the owners or operators of other <br />public water and/or se%~er systems in Cabarrus County for future <br />water and sewer development. Such agreements should include all <br />aspects of such water and sewer systems, including, but not <br />limited to, plans, specifications, materials, line sizes, fees, <br />ckarges and the like. <br /> <br /> 14. Method of Amendment/Termination of Agreement. This <br />Agreement may be amended or terminated only by a vote cf the <br />majority of the members cf each of the respective governing <br />boards of KANNAPOLIS and CABARRUS. Except as expressly modified <br />herein, the "Agreement to Supply Treated Water" and the <br />"Agreement Relative to the Construction, Operation and <br />Maintenance of a Water Supply Reservoir and Related ~4atters" <br />dated I~ovember 20, 1959, be and they are hereby ratified and <br />reaffirmed. <br /> <br /> 15. Warrant~es. KAA~APOLIS and CASARRUS hereby warrant and <br />represent that: <br /> <br /> (a) Execution of this Agreement and full <br /> performance cf its own obligations hereunder are fully <br /> authorized by law; <br /> <br /> (b) Each has comp!led or will comply with al! <br /> procedures necessary to render its execution of this <br /> Agreement and the performance of its obligations <br /> hereunder as valid, legal and binding acts of <br /> KA~APOLIS cr CABARRUS, respectiYely; and <br /> <br /> (c) All contracts for work to be done pursuant to <br /> this Agreement will be performed in accordance with the <br /> laws and regulations to which CABARRUS and KANNAPOLIS <br /> are subject, expressly including, but not limited to, <br /> the public b~dd~ng laws of the State of North Carolina. <br /> <br /> <br />
