Planning and Zoning Commission Minutes <br />April 16r 1992 <br /> <br />Paqe 8 <br /> <br />Mr. Shultz asked would that require, the parcel that the <br />house is on to be rezoned back to ARR? <br /> <br />Mr. Marshall stated no it would not. The C-2 states that <br />any residential use within the C-2 zoning district must <br />meet the lot size requirements, and size requirements <br />only, of the nearest residential district. So that <br />would be a one acre lot based on the ARR zoning. <br /> <br />Chairperson Randall said her concern is, the Thoroughfare <br />Overlay Zone and she spoke to Mike Downs, Zoning <br />Administrator, about this earlier. Her concern is <br />traffic moving onto and off of Highway 24/27. She was <br />puzzled to say the least by those recommendations that if <br />this were rezoned, she is saying this for the members of <br />the board, they would not have to comply with the <br />Thoroughfare Overlay Zone. The driveway now is an open <br />strip along Highway 24/27, it is not really a cut and she <br />has some concerns about that because of the traffic. <br />Chairperson Randall said Mr. Downs seems to feel, to <br />justify his interpretation of that, she was not <br />challenging that, she was trying to question that and <br />understand it, that since they are not changing anything, <br />in terms of their structures, there would be no need to <br />change the requirement about the driveway. Chairperson <br />Randall said she thinks when the road becomes wider DOT <br />will not permit, she assumes, that same kind of entrance <br />onto Highway 24/27. She said she is saying this for Mr. <br />Carriker's benefit as much as anyones and that is so he <br />will understand that if this property is divided and if <br />the C-2 zoning is approved, that will be with the <br />limitation of having the DOT permits, the correct ones, <br />and not too many access points in a reasonably short area <br />along the highway. <br /> <br />Chairperson Randall opened the public hearing on Petition 92-06 <br />asking if anyone would like to speak for or against this petition. <br /> <br />Mr. Hartgen said he is confused about this petition. He <br />asked for someone to explain to him why this is being <br />requested. <br /> <br />Mr. Marshall stated that there are three businesses <br />within this main building. Those businesses are being <br />divided, and they wish to sell the land that lies <br />underneath the building. In order to make that <br />division, the lot lines will follow the wall lines <br /> <br /> <br />
