Planning and Zoning Commission Minutes
April 16~ 1992

Paqe 10

Mr. Amos said he would like it to meet the intent of the
thoroughfare overlay and what they are doing is
potentially putting in a change that would allow a use
that would be contrary to the overlay.

Mr. Smith said he is not sure that the board would be the
determining factor to begin with. If DOT wants to give
them 10 right-of-way permits, they could give it to them.

Chairperson Randall stated she would like to remind the
board of what Mr. Alexander said. Essentially, what the
board is focusing on at this point is not divisions, that
may be their intent, but the board's determination factor
at this point is to say whether they should change this
from the current C-4, highway business district to a C-2,
neighborhood commercial district.

Mr. Marshall said he would like to add to what Mr.
Alexander said. He understands from the petitioner that
there is some time constraint, and the petitioner would
like a decision on this. It has been the board's
practice, with ~abling, to ask the petitioner if they
would like to have their petition tabled.

Mr. Hartgen asked Mr. Marshall if this were approved
would they have to come back for a subdivision approval.

Mr. Marshall said no, it could be approved in the office
as a conveyance plat.

Chairperson Randall closed the public hearing on Petition 92-06.

There being no further discussion, Mr. Amos MOTIONED,
seconded by Mr. Moose to approve Petition 92-06 zoning
atlas amendment. The vote was unanimous.

Chairperson Randall introduced the eighth item on the Agenda,
Eastern Area Plan Draft.

Mr. Marshall addressed the board presenting the Eastern
Area Plan Draft. He stated this is the largest of the
area plans the staff has conducted so far, and there have
been four others. He said most of the sparsely -
populated area will~remain open agricultural with spots
of commercial and industrial areas and potential sites
for medium density residential. After discussion of the
Eastern Area Plan, Mr. Amos asked Mr. Marshall to look at
the I-X zone and bring it back to the board.
