Page 1 of 10 <br /> <br /> THIS AG~k~w~T, entered into as of this 1st day of July, 1992 by <br />and between .Consolidated Coin Caters Corporation hereinafter <br /> <br />hereir~ter referred to as the "purchaser." <br /> <br />WI TNE S SETH THAT: <br /> <br /> WHEREAS, the Purchaser desires to engage the Caterer to render <br />services in connection with a nutrition progra~ for the elderly <br />hereiDafter referred to as the "Program"), provided through the <br />Older Americans Act grant funds provided to the Purchaser <br />through the Centralina Council of Gove~,,~_nts from the North Carolina <br />Division of Aging and the United_ States Department of Health and Human <br /> <br /> WHEREAS, the caterer is a food services management c~any with <br />the demonstrated capacity and desire to supply services; <br /> <br /> NOW ~uRE, in consideration of the premises and the mtual <br />covenants and agreements hereinafter contained, the parties hereto <br />agree as follows: <br /> <br />Caterer agrees to sell and Purcha~er agrees to buy all <br />Purcha~er,s requ{rements for this program aocording to the <br />provisions of the agreement. Caterer agrees not to sub-contract <br />for the delivery of the services called for in this agreement. <br /> <br />~nis Agreement will be i~ effect and services will be delivered <br />beginning July 1, 1992 and continue through June 30, 1993. <br /> <br />Purcba~_r will order from the Caterer an average 230-250 meals <br />daily for 250 serving days, depending on the availability of <br />fur~ng. Caterer shall be obligated to deliver meals to six (6) <br />sites designated by the Purch~-~er and listed, in Schedule "A" of <br />Services. Additional meals or additional sites may be added by the <br />program as program resources allow and the Caterer will deliver any <br />such meals for the same unit price specified in this agreement. <br />New sites will not be added for less than 25 meals per day. <br /> <br />0 <br /> <br />Caterer will deliver meals in kulk to each site Monday through <br />Friday, during the period of this agreement with the exception of <br />the holidays specified in Schedule "B" Special Conditions, or <br />except as provided for under Item 8 presented below. <br /> <br />The purcb~n~e and delivery price for all meals ordered by <br />Purcb~-~_r shall be as follows: a unit price of $2.1934 plus <br />applicable sales <br /> <br /> <br />
