WHEREAS, CABARRU$ and the FRIENDS OF THE LIBRARY desire to enter into a con%tact whereby the FRIENDS OF THE LIBP~kR¥ will undertake programs and activities in or about the Kannapolis branch of %he Cannon Memorial Library to maintain the Holt Collection and to further art education in Cabarrus County pursuant to the wishes of Ms. Holt as set forth in her will in the Holt Bequest; and WHEREAS, under the provisions of N.C.G.S. 153A-11, 153A- 149(c)(6a), and N.C.G.S. 1GOA-458 and related statutes, CABARRUS is authorized to contract with the FRIENDS OP THE LIBR3%R¥ to maintain the Holt Collection and to appropriate the Holt Bequest to the FRIENDS OF TH~ LIBRARY for public purposes; and W~E~EAS, the FRIENDS OP THE LIBRARY desires to maintain the Molt Collection and to implement the.intent of the Holt Bequest for the benefit of the citizens of cabarrus County through the Kannapolis Branch of the Cannon Memorial Library, and CABARRUS has determined that the FRIENDS OF THE LIBRARY is singularly suited to implement and advance the purposes set forth in the Holt Bequest; NOW, THEREFORE, in consideration of the premises, CABARRUS and the FRIENDS OF THE LIBKAR¥ do mutually agree as follows: 1. This contract shall commence on the date hereof and sha~l exist and continue for ~o long as the FRIENDS OF THE LIDRARY shall continue to maintain the Holt Collection or ~o administer the ~und~ of the Holt Bequest transferred herein to the FRIENDS OF THE LIBRARY by CABARRUS; NOTWITHSTA34DING the foregoing, this Agreement may ~e terminated by CA~ARRUS or the FRIENDS OF THE LIEP~A~Y upon ninety (90) days written advance notification ~y either party to the other.
