Section 9. <br /> <br /> 10 <br />(3) Public Parks. It shall be unlawful for any person owning or having <br /> possession, charge, custody or control of any animal to take the <br /> animal into or allow the animal to enter any county park or public <br /> property without being at all times under restraint of a leash. <br />(4) Park Areas. It shall be unlawful for any person owning or having <br /> <br /> possession, charge, custody or control of an animal to take the <br /> animal into picnic areas, pond areas, and children's play areas of <br /> any county park. This restriction shall not apply to guidedogs or <br /> hearing aid dogs in the company of sight-impaired or hearing-impaired <br /> persons. <br /> <br />(5) Violations. Issuance of a citation for a violation of Section 8, <br /> "Restraint of Animals," is directed toward and against the owner of <br /> an animal. The purpose of the issuance of a citation is to effect <br /> the conduct of the owner of an animal by seeking to have an owner <br /> responsibly maintain sufficient restraint and confinement of his/her <br /> animal. Therefore, an owner of an animal shall be subject to <br /> escalating penalties for each violation of Section 8 allowed by the <br /> owner, whether the animal is the same animal, a different animal, or <br /> various animals belonging to the owner. Each violation of Section 8 <br /> shall subject the owner to the following escalating citation <br /> penalties: <br /> <br /> OWNER'S OFFENSE PENALTY <br /> <br /> 1st $ 50 fine and seizure <br /> 2nd $100 fine and seizure <br /> 3rd and subsequent offenses $200 fine and seizure <br /> <br /> Public Nuisance <br /> <br />(1) The actions of an animal constitute a nuisance when an animal <br /> disturbs the rights of, threatens the safety of, or damages a member <br /> of the general public, or interferes with the ordinary use and enjoy- <br /> ment of another's property. <br /> <br /> <br />
