Section 9.

10
(3) Public Parks. It shall be unlawful for any person owning or having
possession, charge, custody or control of any animal to take the
animal into or allow the animal to enter any county park or public
property without being at all times under restraint of a leash.
(4) Park Areas. It shall be unlawful for any person owning or having

possession, charge, custody or control of an animal to take the
animal into picnic areas, pond areas, and children's play areas of
any county park. This restriction shall not apply to guidedogs or
hearing aid dogs in the company of sight-impaired or hearing-impaired
persons.

(5) Violations. Issuance of a citation for a violation of Section 8,
"Restraint of Animals," is directed toward and against the owner of
an animal. The purpose of the issuance of a citation is to effect
the conduct of the owner of an animal by seeking to have an owner
responsibly maintain sufficient restraint and confinement of his/her
animal. Therefore, an owner of an animal shall be subject to
escalating penalties for each violation of Section 8 allowed by the
owner, whether the animal is the same animal, a different animal, or
various animals belonging to the owner. Each violation of Section 8
shall subject the owner to the following escalating citation
penalties:

OWNER'S OFFENSE PENALTY

1st $ 50 fine and seizure
2nd $100 fine and seizure
3rd and subsequent offenses $200 fine and seizure

Public Nuisance

(1) The actions of an animal constitute a nuisance when an animal
disturbs the rights of, threatens the safety of, or damages a member
of the general public, or interferes with the ordinary use and enjoy-
ment of another's property.
