That the sheriff may respond to a request for mutual aid <br /> assistance ~f he determlnea that the request can be honored <br /> without impairing the CapaCity of the Sheriffs Department <br /> ' to provide law enforcement protection to the proper~y and <br />~ I citizens of Cabarr~s County. <br /> il 3. That the Sheriff is hereby authorized to request mutual aid <br /> i assistance from other law enforcement agencies in accordance <br /> with such reasonable arrangements, terms and conditions as <br />il may be agreed upon between the respective head of the law <br />· enforcement agencies. <br />~ 4. That the Sheriff is hereby authorized to permit officers of <br />~ the Cabarrus County Sheriffs Department to work temporarily <br />ilI with officers of th, requ.sting agencle., including in an <br /> undercover capacity, and to this extent may lend equipment <br /> and supplies. <br /> <br /> $. That Cabarrus County shall assume all liability and respen- <br /> sibility for the death or injury of any Cabarrus County <br /> Sheriffs Department officer while responding to a request <br /> I for law enforcement mutual aid in accordance with North <br /> Carolina law. Cabarrus County will not assume liabillty <br /> or responsibility for the injury or death of any ~ersonnel <br /> i of the requesting agency. <br /> 6. That Cabarrus County shall assume all costs of salaries, <br /> I wages, bonuses or other compensation for its o~ personnel <br /> who respond for duty under the terms of this agreement, and <br /> shall assum~all costs ~nvolvlng the use of sup~lies and <br /> equipment u~ed s~ecifically in response to the request for <br /> mutual aid assistance. <br /> <br /> 7. That while on duty with a requesting agency, C~barrus Count~ <br /> I Sheriffs Depaz~ment officers shall be subject to lawful <br /> operational orders of the commanding officer of the request- <br /> ing agency, but for personnel and administrative purposes, <br /> they shall remain under the control and authority of the <br /> I Sheriff of Cabarrus County. <br /> <br />· 8. That the Sheriff may at any time terminate a mutual aid <br /> I agreement upon written notice to the chief executive officer <br /> of the other agency. <br /> <br /> I 9. That when cabarrus County Sheriffs Department ~rsonnel are <br /> sent to another jurisdiction pursuant to this a~re~ment, the <br /> jurisdictional authority, rights, pri¥ileges and i~munitiea~ <br /> including coverage under Worker's Compensation ~aws, which <br /> I they have in Cabarrus shall be extended and in- <br /> County <br /> to <br /> clude the area in which like benefits and authorities are or <br /> could be afforded law enforcement personnel of ~he receiver <br /> I agency and shall also bs extended to the area located be- <br /> <br /> <br />
