DATE: February 11, 1991 <br /> <br /> SUBJECT: Cabarrus County Zoning Text Amendment Voting <br /> Requirements <br /> <br /> At the January 30, 1991 Cabarrus County Planning and Zoning <br /> Commission meeting, Commissioner Bob Smith brought up an apparent <br /> (and actual) discrepancy in the cabarrus County Zoning Ordinance <br />I and statements made in a book entitled Tb~ Zoning Board of <br /> Adjustment in North C~rol~na. Second Edition regarding voting <br /> requirements. In further evaluating the issue, it is clear that <br /> I Section 8.4-2 must be amended to comply with North Carolina General <br /> Statutes 153A-345. I would suggest the phrase, "present for the <br /> hearing" be deleted. <br /> <br /> The significance of a change is that we now <br /> such <br /> should <br /> strongly consider the use of alternate members. While not mandated <br /> and not used in all communities, it appears as though we should <br /> I have three alternate members. Otherwise: variances, conditional <br /> uses, appeals, and changes in non-conforming uses could not be <br /> approved if more than one person was absent or had a conflict of <br /> I interest situation. Thus, I am recommending the following <br /> paragraph be added to Section 8.1: <br /> <br /> The Board of Commissioners shall also appoint <br /> m three (3) alternate members to serve on the <br /> Cabarrus County Planning and Zoning Commission <br /> in the absence, for any cause, of any regular <br /> m member if a board of adjustment duty is to be <br /> exercised at the upcoming regular or special <br /> meeting. Such alternate members shall be <br /> <br />m appointed for ~ year terms and shall have and <br /> exercise all the powers and duties of. a <br /> regular member when serving in his or her <br /> absence.
