Nawto~.!ann!ng and Zoning Director DATE: February 11, 1991 I SUBJECT: Cabarrus County Zoning Te'xt Amendment Voting Requirements I At the January 30, 1991 Cabarrus County Planning and Zoning Commission meeting, Commissioner Bob smith brought up an apparent (and actual) discrepancy in the Cabarrus County Zoning Ordinance I and statements made in a book entitled Zo~Da Board of The Adjustment in North C~ro]!na. Second Edit~oR regarding voting requirements. In further evaluating the issue, it is clear that I section 8.4-2 must be amended to comply with North Carolina General statutes 153A-345. I would suggest the phrase, "present for the hearing" be deleted. I The significance of such a change is that we should now strongly cons/der the use of alternate members. While not mandated and.not used in all communities, it appears as though we should Ihave three alternate members. Otherwise, variances, conditional uses, appeals, and changes in non-conforming uses could not he approved if more than one person was absent or had a conflict of I interest situation. Thus, ! am recommending the following paragraph be added to section 8.1: The Board of Commissioners shell also appoint ~ three (3) alternate members to the serve on Cabarrus County Planning and Zoning Commission in the absence, for any cause, of any regular I member if a board of adjustment duty is to be exercised at the Upcoming regular or special meeting, such alternate members shall be iappointed for ~ year terms and shall have and exercise all the powers and duties of a regular member when serving iR his or her absence.
