Roesler <br /> Director of Intergovernmental Programs <br /> <br /> SUBJECT: Alexander vs. Flaherty <br /> <br /> DATE: March 14, 1990 <br /> <br /> In December 1989 the North Carolina Department of Humeri Resources <br /> entered Into e consent order and settlement agreement Between the <br /> state agency end Legel Services of North Cerolina in the case o£ <br /> Clara Alexander v Rene Hill (now Alexander v Flaherty). The <br /> primary issues in the case are the timely processing of AFDC and <br /> Medicaid applications and the perceived discouragement of potential <br /> applicants from applying for the programs. <br /> <br />You will recall that under the terms of the settlement agreement, <br />a monitoring instrument was developed which was used last year to <br />test each county's compliance with various program requirements. <br />Counties were classified into three categories, depending on the <br /> achieved the monitoring instrument: <br /> score <br /> on <br /> <br /> Category I = 455 - 500 points <br /> Category II = 355 - 454 points <br /> C~tegory III = 0 - 355 points <br /> <br />Under this plan, Category III counties were to be required to take <br />corrective action and pay a sanction equal to 7.5% of their <br />combined AFDC and Medicaid non-federal costs of administration. <br />Category II counties were to take corrective action and improve <br />their scores by 10% in the next monitoring in order to prevent <br />paying a sanction equal to 3.75% of the non-federal costs of <br />administration for AFDC and Medicaid. Category I counties had to <br />take corrective action as appropriate, but were assessed no <br />sanctions. <br /> <br />The 1989 settlement agreement provided for modifications in the <br />monitoring instrument and sanction plan by mutual consent of the <br />parties (the Department of Human Resources and Legal Services). <br />Since November of 1990 the Association has been participating with <br />the Department of Human Resources and the Social Services <br />Directors' Association in negotiations with North Carolina Legal <br /> <br /> ALBERTCOA~SLOCALGOVERNMENTCE~ER.215NORTHDAWSONSTRE~ <br /> P.O.
