Such action shall <br /> I include, but not be limited to the <br /> following: <br /> upgrading, demotions, or transfers; recruitment or recruitment <br /> advertising; layoffs, or terminations; rates of pay or other <br /> I forms of compensation; selection for training including <br /> apprenticeship; and participation in recreational and <br /> educational activities. The Agency certifies that it <br /> i presently has in effect an affirmative action program. The <br /> Agency agrees to post in a conspicuous place available to <br /> employees and applicants for employment, notices setting forth <br /> the provisions of this non-discrimination clause. The Agency <br /> I shall in all solicitations or advertisements for <br /> subcontractors or employees placed by or on behalf of the <br /> Agency, state that the Agency is an "Equal Opportunity <br /> I Employer". (b) The Agency shall make no distinction-because <br /> of race, color, handicap, religion, sex or national origin in <br /> providing to eligible individuals any services or other <br /> i benefits under projects financed in whole or in part with <br /> Older Americans Act or other funds provided under this <br /> contract. (Thi9 provision excludes age since these funds are <br /> allocated to serve only older persons by design and by law.) <br /> I (c) The Agency shall keep such records and submit such <br /> reports concerning characteristics of applicants for <br /> employment and employees as the Council and the North Carolina <br /> I Division of Aging may require. (d) The Agancy agrees <br /> to comply with such guidelines as the Council or the North <br /> Carolina Division of Aging may issue to implement the <br /> <br /> i requirements of this paragraph. <br /> 22. ~u4it. The Agency agrees to have a financial and compliance <br /> audit performed within four (4) months of the close of the <br /> I Agency's fiscal year. This audit must be completed at the <br /> Agency's expense and shall be performed by an independent firm <br /> of Certified Public Accountants. The auditing firm shall be <br />I selected by methods recommended by the North Carolina Local <br /> Government Commission and the contract between the Agency and <br /> the independent auditing firm shall be in a form approved by <br /> the North Carolina Local Government Commission. If the <br />I Agency's fiscal year is different than the period July 1 <br /> through June 30, a copy of both audit reports covering the <br /> period of July 1 through June 30 shall be provided. If the <br />I audit of the Project is conducted as part of an audit of other <br /> Agency projects not covered under this contract, then the <br /> revenues and expenditures for this Project, and each service <br />i funded,.must De clearly and separately stated. At a minimum, <br /> the audit should include an accountant's opinion, a balance <br /> sheet, a statement of revenues, expenditures, and fund <br /> balance, certification of the number of units of service <br />I actually provided and documented by the Agency, a ttnit cost <br /> analysis for each service, and a management letter.
