llI. ~OOECT E~:ECI}T]0N <br /> <br /> A. The State and the Applicant mutually agree to perform this project <br /> agreement in accordance with the Land and Water Conservation Fund Act of 1965, <br /> as a~nended (78 Stat. 897); with the terms, promises, conditions, plans, <br /> specifications, estimates, procedures, ~aps and assurances submitted in <br /> conjunction with the project proposal for this agreement; and with the terms <br /> I and conditions of the Manual. <br /> ~. The Applicant agrees to execute and complete the project in <br /> accordance with the time schedule se: forth in the approved project proposal. <br /> I Failure to render satisfactory or to complete this or other <br /> progress <br /> any <br /> project which is the subject of Federal assistance under this program to Cne <br /> satisfaction of :he State or the Director may be cause for the suspension of <br /> I all obligations of the State under this agreement. <br /> C. Construction contracted for or performed by the Applicant shall meet <br /> :he following requirements: <br /> <br /> 1. Contracts for construction shall comply with the provisions of 43 <br /> CFR Part 12, Uniform Administrative Requirements for Grants and <br /> I Cooperative Agreements to State and Local Governments. <br /> 2. Contracts for construction shall comply with the Office of <br /> I Management and Budget Circular No. A-87, Cost Principles for State and <br /> <br /> i 3. No grant or contract may be awarded by the Applicant or by any <br /> contractor for the Applicant to any party which has been debarred or <br /> suspended under Executive Order 12569. <br /> <br /> I 4. The Applicant shall comply with the contract compliance procedures <br /> required by Executive Order 11266, as amended (3 CFM. 169), and by the <br /> Office of Federal Contract Compliance Programs (OFCC P) of the Department <br /> I of Labor (gl CFR 60-4). These procedures shall apply to all grants <br /> involving Federally assisted construction contracts over $10,000. <br /> <br /> I a. The Applicant shall include the following in solicitation for <br /> offers and bids on federally assisted construction contracts over <br /> $10,000 (not required for newspaper or advertisements): <br /> <br />I (1) 'Notice of Requirement for Affirmative Action to Ensure <br /> Equal Employment Opportunity,' including goals ~hich are to <br /> be inserted by contracting officer or applicant. <br />I (2) 'Standard Federal Equal F~ploy~ent Opportunity Construction <br /> Contract Specifioation'. <br /> <br />I b.
