In the event of the contractor's noncompliance ~ith the <br /> I non-discrimination clauses of this contract or pith any of such <br /> rules, regulations, or orders, this contractor may be cancelled, <br /> te~inated, or suspended tn v hole or in part and the contractor <br /> I may he declared lnell§lble for further Government contracts in <br /> accordance with procedures authorized in Ex~cutive Order <br /> 11266 as a~ended, and such other sanctions may be imposed and <br /> remedies invoked as provided in Executive Order No. 11266, as <br /> -m <br />[] a~ended or by rule, regulat£ons, or order of the Secretary of <br /> Labor, or as otherwise provided by law. <br /> <br /> I g. The contractor vi11 include the provisions of a through f in <br /> every subcontract or purchase order unless exempted by rules, <br /> regulations, or orders of the Secretary of Labor issued pursuant <br /> to Section 206 of Executive Order No. 11266, so that such <br /> provisions will he binding upon each subcontractor or vendor. <br /> The contractor will take action with respect to any subcontract <br /> or purchase order as the contracting agency may direct as a means <br /> I of enforcing such provisions, including sanction for <br /> noncompliance: ~rovided however, that in the event the <br /> contractor becomes involved in, or is threatened with, litigation <br /> I with a subcontractor or vendor as a result of such direction by <br /> the contracting agency the contractor may request the State to <br /> enter into such litigation to protect the interest of the State. <br /> <br /> I 6. The State shall (1) comply pith the above previsions in <br /> construction work carried out by itself, (2) assist and cooperate actively <br /> with the Secretary of the Interior and the Secretary of Labor in obtaining <br /> I the compliance of contractors and subcontractors pith the above contract <br /> provisions and with the rules, regulations, and relevant orders of the <br /> Secretary of Labor, (9) obtain and furnish to the Secretary of the <br /> I Interior and to the Secre:ary of Labor such information as they may <br /> require for the supervision of such co=pliance. (6) enforce the obligation <br /> of contractors and subcontractors under such provisions, rules, <br /> regulat£ons, and orders, (5) carry out sanctions and penalties for <br /> I violatlcn of such contractors and subcontractors <br /> obligations <br /> imposed <br /> upon <br /> by the Secretary of Labor or the Secretary of the Interior pursuant to Par <br /> II, Subpart D, of Executive Order ~o. 11266, as amended, and (6) refrain <br /> I from entering into any contract with a contractor debarred from 11266, as <br /> a~ended. In addition, the State agrees that if it fails or refuses to <br /> comply with these undertakings, the ~P$ may take any or all of this grant; <br /> I refrain from extending any further assistance to the applicant under the <br /> program with respect to which the failure or refusal occurred until <br /> satisfactory assurance of future compliance has been received from such <br /> applicant; and refer the case to the Department of Justice for appropriate <br /> I legal proceedings. <br /> D. The Applicant agrees to secure completion of the vork in accordance <br /> I pith the approved construction plans and specifications, and shall secure <br /> compliance with all applicable Federal, State, and local la~s and regulations. <br /> I - 6- <br /> ! <br /> <br /> <br />
