CONTRACT FOR RESPITE CARE ADULT DAY IIP~LTll FACILITY T~IS AGREEMENT, entered into as of this 19th day of December , 1989 by and between First Assembly Adult Day ~lealtb Center (hereinafter referred to as "Center')sad Cabarrus County Department of Aging, (hereinafter referred to as the "Pruchaser ), WITNESSET~ ~IAT: WIIEREAS, the Purchaser desires to engage the First Assembly Adulth Day Health Center to render services in connection with the Respite care Program for the older adults of Cabarrus County (hereinafter referred to as "Program"), described in the purchaser's contract with Centralina Council of Governments designated for the provision of resDite care services through Title III funds, SSBG -fuuds and Senate gill 15559 fund~ to older adults provided to the Purchaser through Centralina Council of Governments from North Carolina Division of Aging and United States Department of Health and Iluman Services; and ~RF2~, First Assembly Adult Day Ilealth Center is a licensed adult day health facility with the demonstrated capacity and desire to render adult day health services to older adults; NOW TIIEREFORE, in consideration of tile premises and tbe mutual covenants and agreements hereinafter contained, the parties hereto agree as follows: 1. Tile Center agrees to sell and Purchaser agrees to buy Center's respite services. The Center agrees to provide services and activities in accordance with standards as provided by N. C. Division of Aging. (Attached) The Center agrees not to sub-contract for tbe delivery of services called for in this agreement unless mutually agreed by Purchaser and the Center. 2. This agreement will be in effect and services will be delivered beginning December, 1989, and continuing through June 30, 1990. 3. Purchaser will purchase up to 576 unit bours with no more than 48 hours per cleint per month within tile stated contract period. The Center shall be committed to deliver the total units of services requested by the Purchaser. 4. The Center will deliver the Program based on a one hour unit of servlce. Program will be provided in the Adult Day Realth Facility. 5. The purchase and delivery price for all ~mits of service ordered by Purchaser sball not exceed a cost of $26.00 per day. This is the Center's medicaid reimbursable rate. A unit of service shall be $4.33 per hour based oum six bout respite stay. In tile event that more or less than six hoars are contracted by tile participant and purchaser, the number of bours requested shall be divided by $26.00 for tile hourly unit rate thereby not exceeding the $26.00 per day maximum.
