§ 20-187.2. Badges and service side arms of dc- <br /> ceased or retiring members of State, <br /> city and county law-enforcement agen- <br /> cies; weapons of active members. <br /> (a) Surviving spouses, or in the event such members die <br /> ansurvivcd by a spouse, sm'riving children of members of North <br /> Carolina State, city anti cmmty law-enl'orcemcnt agencies killed in <br /> the line of dtfiy or who are memhers of such agencies at tile time of <br /> their deaths, and retiring members el' such agencies shall receive <br /> tipon request and at no cost to them, the badge worn or carried by <br /> such deceased or retiring members. The governing body oF a law- <br /> en£orcement agency may, in its discction, also award to a retiring <br /> member or surviving relative as provided herein, upon request., the <br /> service side arm oF such deceased or retiring members, at a price <br /> determined by snch governing body, upon securing a permit ns <br /> required by G.$. 14402 et seq. or 1.4-409.1 et seq., or without such <br /> permit provided tile Weapon shall have been rendered incapable of <br /> being fired. Governing body shall mean for county and local alcohol <br /> beverage control oflici~rs the county of local board 0falcoh01ic con- <br /> trol; for all other law-enforcement ~fficers with jurisdiction imited <br /> to a municipality or town. the city or tow~ council; for all other law- <br /> enforcement ollicers with countywide jurisdiction, the board o~' <br /> county commi.;sioners; For all State law-enforcement ofllcers, the <br /> bead of tile department. <br /> (b) Active memburs oF North Carolina State law-enforcement <br /> agencies, u ~ou change of type of weapons, may purchase the <br /> weapon worn or carried by such member at a price Which Shall be <br /> the average yield to tile 8tare from the sale of similar weapons <br />· . during tile p~:~cecling year.
