October 19, 1989. <br /> <br /> ,0203 SITE LOCATION I:ACTORS AND CRITERIA <br /> This Subsection sets out rules for ekchiding sites based upon tbe factors set out ha G.S. 130B-I l which <br /> requires the Cormrfission to consider hydrological and geological factors; environmental a~ld public <br /> health factors; natural and cultural resources; local land uses; transporlatinn factors; aesthetic factors; <br /> availability and reliability of public utilities; and availability of emergency response personnel and <br /> equipment in Ihe development of site selection criteria. <br /> (1) A location shall not be selected to be placed upon tile geological formations of Castle Ilayne; <br /> Shady Dolomite; and Murphy Marble, Andrews Formation a~d Nottely Quartzite, Undivided; <br /> based upon tile Geologic Map of North Carolina (printed by the Department of Enviromnent, <br /> Health and Natural Resources, [985 Edition). <br /> (2) A location shall not be selected to be placed within ten miles from tbe canterline of the Blue <br /> Ridge Parkway. <br /> (3) A location shall not be selected within five mi/es oftbe State boundary. <br /> (4) A location shall not be selected to be placed within tile corporate limits, effective November <br /> 1989, of a municipality except on land zoned, as of November 7, 1989, to permit industrial uses. <br /> Corporate limits based upon 1988 North Carolina Department of Tmnsp0rtatinn maps which <br /> contain 1987 data submitted by tile municipalities or 1990 pre-census maps from tile United States <br /> Census Bureau, wldchever is more curreot and complete, will be used in tile second phase of <br /> statewide screening. <br /> (5) A location shall not be selected within a census tract based upon the 1980 data from the United <br /> States Census Bureau tbat bas a population density greater than 500 people per square mile. <br /> (6) A location shall not be selected to be placed upon a general soil association type that floods in <br /> more than fen percent of the area based upon United States Department of Agriculture General <br /> Soils Association data. <br /> (7) The site shall have an area designated to encompass all hazardous waste management units, as <br /> det'med at 10 NCAC 10P .0002 and 40 CFR 260.10(63), and said designated area sba0 be at least <br /> 75 acres in size.' <br /> (8) The site must have at leasl 1000 feet between the outside of any hazardous waste management <br /> unit and the nearest property boundary of the site. <br /> (9) A location shall not be selected to be placed upon a general soil association type that has a surface <br /> slope greater than 15 percent for more than 70 percent of the soil &rea based upon United States <br /> Department of Agriculture Geoeral Soils Association data. <br /> (10) A location shall uot be selected such that a hazardous waste management unit is placed within <br /> 0.25 miles (1320 feet) of an off-site groundwater well from which water has been drawn for use <br /> within two years prior to January 25, 1990, or 1000 feet of its zone of influence, described as a cone <br /> of depression, wlfichever is greater. <br /> (Il) A location shall not be selected to be placed: <br /> (a) witlfin a drainage area for a Class I or II Reservoir as defined at 10 NCAC 10D.0702(6) and (7); <br /> <br />NORTII CAROLINA ADMIATSTRATIVE CODE 01/$1190 Page 2 <br /> <br /> <br />
