Box 707 <br /> Concord, N, C. 28016-0707 <br /> <br /> SUBJECT: Agreement for C~D service Jn NW Cabarrus County <br /> <br /> Dear Mike: <br /> <br /> It was good to meet with you, Jim, and Henry yesterday to discuss our <br />mutual concerns along the interface of our counties. It is especially <br />refreshing to talk with someone who has similar views relative to issues that <br />sometimes have a way of getting complicated when dealing between jurisdictions, <br /> <br /> Pursuant to our discussions, I am outlining provisions that I think should <br />County.be addressed when considering C~D service into the northwestern part of'your <br /> <br /> 1. C~D will build a wastewater plant on land donated by Edgeco in <br /> conjunction with their River Bun project located in Mecklenburg and <br /> Cabarrus Counties. <br /> <br /> 2. CMUD rates applicable to outside city customers would apply. As we <br /> discussed, this rate is currently 1.4 times ~he inmide city rate. but <br /> the factor is decl~ning by one tenth each July. It would l~kely be <br /> reduced to the same for inside city as outside city by the time this <br /> project ~s completed, <br /> <br /> 3. Standard CMUD extension and other policies would apply. These policies <br /> are the same throughout the CMUD system. <br /> <br /> 4. You would have approval authority before extension contracts are <br /> entered into for any development within Cabarrus County. <br /> <br /> 5. Water service will be made available as an extension to mains serving <br /> the River Run development. <br /> <br /> 6. In the event we have any Jurisdictional problem with exercising the <br /> right of eminent domain in Cabarrus County, you will assist is <br /> acquiring any Rights of Way for approved projects. <br /> <br /> 7.
